98-250RESOLUTION NO. 98R- 250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING CONDITIONAL USE PERMIT NO. 3915 AND AMENDING RESOLUTION NO. PC97-35 ACCORDINGLY WHEREAS, on March 31, 1997, the Planning Commission of the City of Anaheim, following a duly noticed public hearing, adopted its Resolution No. PC97-35 granting Conditional Use Permit No. 3915, to permit the expansion of a vacant existing gasoline service station, with the addition of an accessory convenience market with fast food service, retail sale of beer and wine for off-premises consumption only, and construction of a new drive-through, self-serve car wash (collectively the "facilities") on certain premises located at 1199 South State College Boulevard (referred to herein as either the "premises" or the ~property") with a waiver of certain provisions of the Anaheim Municipal Code; and WHEREAS, on June 9, 1997, the Planning Commission approved final elevation, landscaping and sign plans for said premises and facilities; and WHEREAS, an outdoor advertising structure currently exists on the premises which structure apparently exists as a legal non-conforming use; and WHEREAS, Section 18.02.058.014 of the Anaheim Municipal Code provides that, while a nonconforming use exists on any lot, no other use shall be permitted, even though such other use would be a conforming use; and WHEREAS, the site plans submitted to, and approved by, the Planning Commission in conjunction with the approval on Conditional Use Permit No. 3915 did not indicate that the outdoor advertising structure was to remain on the premises in conjunction with the proposed facilities, including the proposed new car wash use; however, said plans did clearly indicate each of the other existing structures and features which were to remain on the premises in conjunction with the approved facilities; and WHEREAS, said site plans indicate that the footprint of the proposed car wash structure circumscribes and encompasses the same area as the two existing support poles for the outdoor advertising structure; and WHEREAS, the plans submitted to, and approved by, the Planning Commission in conjunction with the approval of Conditional Use Permit No. 3915 did not indicate the support poles for the advertising structure within the proposed car wash; and
