RESOLUTION NO. 78R- 522
A RESO UTION OF THE CITY COUNCIL OF THE CITY
OF ANA 1M APPROVING THE TERMS AND CONDITIONS
OF AN GREEMENT FOR RIGHT-OF-WAY ACQUISITION
WITH T COUNTY OF ORANGE AND AUTHORIZING AND
DIREC NG THE MAYOR AND CITY CLERK TO EXECUTE
SAID AREEMENT.

Orange ood Avenue between Ninth Street and
Euclid Street)
WHEREt the Orange County Board of Supervisors, by
resolution of M 31, 195.6, adopted the Master Plan of
Arterial Highway to serve the entire County including the
incorporated cit ' s thereof; and

WHERE , Articles 2 and 3 of Chapter 9, Division 2,
commencing with ection 1680 of the Streets and Highways Code
authorize a co y, if it so desires, to expend fundsappor-
t:loned to it out of the California Highway Users Tax Funds for
aid to cities a in the improvement, construction, or repair
of streets with a city; and
WHEREf' the Orange County Board of Supervisors and
th,e Orange Count Division of the League of California Cities
have agreed upo a cooperative financial program for the
establishment, nstruction, and maintenance of a County
Arterial Highwa~ System known as the Arterial Highway Financing
Program; and .
WHERE~' the Board of Supervisors has, by appropriate
action, provide in the budget of the Special Road Improvement
Fund for the Fi al Year 1976-1977 funds for the :lmprovement
of streets with the incorporated cities of the County, which
streets are a p , t of the County's Master Plan of Arterial
Highways; and

WHERE , the Board or Supervisors on November 5, 1958,
has, by formal solution, adopted the formal procedure for the
administration the Arterial Highway Financing Program, .as
revised" w1rlch ocedure is outlined in a document on file with
the County Cler , formally known as the County of Orange
Arterial Highwa~ Financing Program Procedure Manual; and
WHERE~" it is mutualiy agreed between the City of
Anaheim and the lCounty of Orange that Orangewood Avenue between
Ninth Street an~ Euclid Street (Project No. 859), a street
included in the ~range County Master Plan of Arterial Highways,
is a street of ~neral County interest and should be improved
in accordance w~h the policies of the Arterial Highway Financing
Program; and

WHEREAS,ithe City of Anaheim as Lead Agency has
completed the env~onmental assessments as required by the
California Enviro ental Quality Act of 1970 by approving a
Categorical Exempt on for the street improvement, a copy of
which is on rile w, th the County; and
WHEREAS,,! the City of Anaheim has filed the Notice
of Determination ~th the Clerk of the Board of Supervisors
of the County; and!

WHEREAS~I}lO additional environmental documents are
required for comp~ance with the California Environmental
Quality Act; and !
WHE REA S%' ,the City of Anaheim and the County of
Orange desire to e 'ter into an agreement in order to
accomplish the im ovementof Orangewood Avenue between Ninth
Street and Euclid treet (Project No. 859) in accordance with
the policies of t~ Arterial Highway Financing Program; and
WHEREAS~I~an agreement has been prepared, the terms
of which are sati>:lfactory to the City of Anaheim.

NOW, T~EFORE, BE IT RESOLVED that the terms and
conditions of said! agreement are hereby approved and accepted.
BE IT FQRTHER RESOLVED that the Mayor and City Clerk
be, and they are ~reby, authorized and directed to execute
said Agreement on "ehalf of the City of Anaheim.
THE FORmOING RESOLUTION is approved and adopted
