ION OF THE CITY COUNCIL OF THE CITY
THE SALE OF CERTAIN CITY-OWNED
AUTHORIZING THE CITY ENGINEER TO
ANDONMENT PROCEEDINGS TO AN EASE-
PUBLIC ROAD AND UTILITY PURPOSES.
WHEREAS, the City of Anaheim is the owner, in fee, of
the following desc 'bed parcel, to wit:
That certain ontage roadway located in the City of
Anaheim, Coun of Orange, State of California, being
that portion f Relinquishment No. 605, as shown on
the State Hig ay Map Book No.5, page 48, recorded
in the office of the County Recorder of said Orange
County, descr' ed as follows:
Beginning at e northwest corner of said Relinquishment
No. 605; then S 870 44' 03" E, 73.00 feet; thence S
02015' 57" W, 45.00 feet; thence S- 88027' 43" E, 40.00
feet to the ue point of beginning; thence continuing
S 880 27' 43" E, 300.00 feet; thence S 020 15' 57" W,
801.49 feet; ence N 880 27' 43" W, 40.00 feet; thence
N 020 15' 57" E, 736.49 feet; thence N 430 05' 27" W,
35.13 feet; ence N 880 27' 43" W, 235.00 feet; thence
N 020 15' 57"E, 40.00 feet to the true point of begin-
ning, (herein fter described as "Parcel"); and

WHEREAS, Isaid Parcel is subject to a road and public
utility easement irt favor of the public; and
WHEREAS'~City has received an offer to purchase Parcel
from Etchandy Brat ers Farms for the sum of $71,895.00, said Parcel
to be subject only Ita reservations for easements for ingress and
egress in favor ofJthe City of Anaheim and Orange County Water
District over the ~ntire east-west portion of Parcel and the west-
erly fifteen feet qf the north-south portion of said Parcel; and

WHEREAS~. Etchandy Brothers Farms is willing to grant an
additional easemen.. for ingress and egress to the City of Anaheim
and the Orange Co ty Water District and to cause the improvement
of said easement t a standard equivalent or better than the pre-
sent right of way; ,and

WHEREAS, IParcel is unusable for residential, park, or
open space uses du~ to its unusual configuration; and

WHEREAS, ithe City Council of the City of Anaheim does
hereby determine ~at $71,895.00 is the fair market value of said
Parcel.

NOW, THEIiEFORE BE IT RESOLVED by the City Council of the
City of Anaheim as !follows:

1. That the~sale of Parcel, subject to easements for ingress
and egress, in fa r of the City of Anaheim and Orange County Water
District, for the urn of $71,895.00, at such time as abandonment
proceedings of the ,road and public utility easement is completed.
2. That the~. ity Engineer be, and he is hereby, authorized
and directed to in' uiate the abandonment of the road and public
utility easement 0 .. r Parcel, subject to said reservations for in-
gress and egress u . n the occurrence of the following:
a. Rece~t of $71,895.00
b. Rece~' t of an easement deed for said easement
for ' gress and egress in favor of the City of
Anah 'm and the brange County Water District
c. Rece~t of a bond to guarantee improvement of
said" en-foot easement , to a S.tandard equivalent
to 0 . better than the existing improvements, in
an . unt to be determined by the City Engineer

3. That thet. yor and City Clerk be, and they are hereby,
authorized and dir ted to execute a deed, conveying Parcel, subject
to said reservatio , to Etchandy Brothers Farms, upon completion
of the vacation an abandonment of said road and public utility
easement .1
