RESOLUTION NO. 78R- 505
A RESOLiION OF THE CITY COUNCIL OF THE CITY
OF ANA 1M APPROVING THE SALE OF CERTAIN CITY-
OWNED E SEMENT RIGHTS AND AUTHORIZING AND
DIRECTI, G THE CITY ENGINEER TO COMMENCE PRO-
CEEDINGS TO VACATE AND ABANDON A PORTION OF
ORANGEWbOD AVENUE.
WHEREAS~ the City of Anaheim did purchase
easement for roadL and public utility purposes, said
ment then being n~cessary for slopes for a proposed
overpass; and

WHEREAS~ said overpass, if needed, can be built
in a different m~er within the right-of-way to be retained
by the City; and
WHEREASI, Emkay Development and Realty Company has
agreed to pay theiCity of Anaheim $172,846.08 for theCity's
easement rights aPd to clear Emkay's title to Emkay's
property abutting! Orangewood Avenue in order that Emkay can
develop said prop~rty; and
WHEREA~, the fair market value of said easement
rights is hereby !determined to be $172,846.08; and
WHEREASj, it is desirable to sell said easement
rights to Emkay f10r $172,846.08.
NOW, T~REFORE, BE IT RESOLVED by the City Council
of the City of Aqaheim as follows:
1.
The Cit1Y Council of the City of Anaheim does
hereby!agree to quit-claim City's interest in
said e~sement to Emkay for the sum of $172,846.08.
3.
The Ci~Y Engineer is hereby directed to initiate
abando ment proceedings to vacate and abandon
that p rtion of Orangewood Avenue; said initiation
to co~ence upon receipt of said $172,846.08.
That t~e Mayor be, and he is, authorized and directed
to exequte a quit-claim deed to Emkay, or such other
party ~s Emkay may direct, upon completion of said
abando~ent proceedings by adoption of a resolution
of abarldonment.

4. Any re~enue derived from the sale of said
proper'tiy shall be placed in the City Council
Contingency Fund Revenue Account.
