A RESOLU1ION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DETERMINING THAT A CERTAIN PUBLIC
SERVICE t!SEMENT $HOULD BE ABANDONED AND
ESTABLISrJ:tNG COND!TIONS PRECEDENT TO SAID
ABANDONMBWT.
WHEREAS, 1;he City Council of the City of Anaheim has
elected to proceed J>ursuant to the provisions of the Public
Services Easements Vacation Law (Section 50430 .et seq. Government
Code) in connection with the vacation and abandonment of public
service easements; $.nd
WHEREAS, the City Council did, by resolution duly posted
and published, givEt notice <IIf its intention to abandon the follow-
ing described public service easement (hereinafter "Easement"),
to wit:
Those certain.. 5-foot wide public utility easements
located in thEt.City of Anaheim, County of Orange,
State of Cali:tQrnia, described as follows:
PARCEL ONE
Those two 5-fQQt wide public utility easements lying
parallel with$.nd 5 feet northerly of and 5 feet
southerly of 1JJile northerly and southerlyrigbt of
way lines of Itidge Gate Road, 54 feet wide, as shown
on the map of said Tract No. 8418.
P ARCELTWO
That certain 15-foot wide easement for drainage pur-
poses lying w~thin Lots 64 and 65 and through the
dedicated str~et ,knowm as Ridge Gate Road, in Tract
No. 8418 all ~$ shown on the map of said Tractre-
corded in Boo}t 10, pages 10 through 13, .Miscellaneous
Maps, records of said Orange County; and
WHEREAS, .on the 1st day of August, 1978, a public bearing
was held to allow interested persons to submit evIdence concerning
said proposed abandonment; and .
WHEREAS, the City Council of the City of Anaheim does
find from the evid~nce submitted to it, that said Easement is un-
necessary for presEtnt or pr<llspective public use; and

WHEREAS,the City Council has further determined that
certain conditions must be met prior to making of an order vacating
and abandoning said Easement.

NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does determine that said Easement should be
abandoned and vacated subject to the following conditions:
1. Applicant shall submit a parcel map to the City Engineer
for approval showiqg lots to be created.
2. Reserving unto the City the westerly 5 feet for public
utility purposes.
3. APPlican~' Ishall dedicate all vehicular acc,ess rights
along Nohl Ranch R d to the City. Sa,id access rights can be
dedicated via abov ,mentioned parcel map upon recordation.
4. Applicantrshall construct full street improvements at
no cost to the City: ,along the east side of Old Bucket Lane, along
the westerly edge o/f Ridge Gate Road, as required by the City
Engineer.
5. Applicant shall pay all estimated costs of $600.00 to
abandon, remove, r~ocate or reroute the existing 8-inchwater
line located 5 feeti ,south of the centerline of Ridge GateH Road,
as required by the ~ity Water Division.
BE IT FURlrHER RESOLVED that should the conditions set
torthin the prece~ng parag.raph be fulfilled within one hundred
eighty (18) days of1the date of this Resolution, the City Council
will make its order vacating and abandoning said Easement.
BE IT FURJriHER RESOLVED that should all of said conditions
not be fulf'illed wi~fn said one hundred eighty (1.80) days or such
further time as the! City Council may grant, then this Resolution
shall terminate, and resort shall be had to a new and separate
proceeding.
THE FOREGf)ING RESOLUTION is approved an~ adopted by the
City Council of theiCity of Anaheim this 1st day of August, 1918.
