A RESOLU1ION OF THE CITY COUNCIL OF THE CITY
OF ANAHE M FINDING AND DETERMINING THAT PUBLIC
CONVENIECE AND NECESSITY REQUIRE THE CONSTRUC-
TION AND COMPLETION OF A PUBLIC IMPROVEMENT, TO
WIT:
GILBERT $TREET STORM DRAIN, 900' N/O BROADWAY,
IN THE CtTY OF ANAHEIM, ACCOUNT NO. 13-791-6325-
1090,
APPROVIN~THE DESIGNS, PLANS, PROFILES, DRAWINGS
AND SPEC FICATIONS FOR THE CONSTRUCTION THEREOF;
AUTHORIZ NG THE CONSTRUCTION OF SAID PUBLIC
IMPROVEM · T IN ACCORDANCE WITH SAID PLANS, SPECI-
FICATION, ETC.; AND AUTHORIZING AND DIRECTING
THE CITY! CLERK TO PUBLISH A NOTICE INVITING
SEALED PROPOSALS FOR THE CONSTRUCTION THEREOF.
WHEREAS, public convenience (~nd necessity require the
construction and ~mpletion of a pUblic improvement in the City
of Anaheim, to wi~:
Gilbert Stre$t storm drain, from 900' N/o Broadway to
Broadway, in the City of Anaheim, consisting of the
construction of approximately 780 L.F. of 39" through
27" mainline.R.C.P. storm drain including laterals,
manholes, ca~ch basins; P.C.C. sidewalk and access
ramps and re,urfacing and all appurtenant work in ac-
cordance with plans and delineated in the specifications
on file in the Office of the City Engineer, Account No.
13-791-6325-1090.

AND WHE~ASJ the City Council instructed the

quantities and co ts and make necessary surveys for the construc-
tion of said pub1.c inprovement; and

WHEREAS, said Public Works Department has prepared
said detailed designs, plans, profiles, drawings and specifica-
tions for the construction of said public improvement and has
submitted the same tb the City Council; and
WHEREAS, the City Council finds that said detailed
designs, plans, prof~les, drawings and specifications for said
pUblic improvement above mentioned, are in accordance with good
engineering practice. and are adequate to serve the needs and
requirements of the City of Anaheim and the citizens and
residents in said ar~a for the purposes for which they are
intended, and that t~ey are adequate for the construction of
said public improve~nt and should be approved.
NOW, THERErORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the detailed designs, plans, profiles,
drawings and specifi1cations for said public improvement herein-
above mentioned and described be, and the same are hereby
approved and adopted as prepared by said Public Works
Department
AND BE IT FURTHER RESOLVED that said public improvement
shall be constructe~ in accordance with said detailed designs,
plans, profiles, dr~ings and specifications as prepared by said
Public Works De~ar~nt and hereby approved, and such
addenda or modif ca~fons thereto as may be approved prior to the
awarding of bids therefor.
BE IT FUR~ER RESOLVED that the City Clerk of the City
of Anaheim be, and dhe is hereby authorized and directed to
publish a notice acdording to law, inviting sealed proposals for
the furnishing of a~l plant, labor, services, materials and
equipment, and all 4tilities and transportation, including power,
fuel and water, and performing all work necessary to construct
and complete, in a good and workmanlike manner, in strict
accordance with said detailed designs, plans, profiles, drawings
and specifications a.s prepared by said Public Works
:Qe~tment ., the public improvements hereinabove
men oned and descr{bed, and fixing the 18th day of Januar} ,
19~ at the hour of 2:00 o'clock P.M. as the date and hour or
the opening of said bids at the City Council Chamber in the City
Hall in the City of Anaheim, and that said notice shall be
published twice, th~ first of which publications shall be at
least ten (10) days prior to the date fixed for the opening of
bids, and that said pUblications shall be at least five (5) days
apart.

AND BE IT FURTHER RESOLVED that the successful bidder
or bidders shall be required to enter into a contract with the
City of Anaheim in the manner and form approved by the City
Attorney of the City of Anaheim for the construction, installa-
tion and completion of said public improvement hereinabove
mentioned and described, in accordance with the plans and

specifications prepared by said Public Works De~artment. ,
the notice inviting sealed proposals, this resolu ion and all
applicable City Or~inances or Code Sections and the laws of
the State of Califprnia, and shall be required to post bonds
and insurance in t~e amounts and within the time required by
law, as specified ~n the notice inviting sealed proposals,
and in a form apprOved by the City Attorney.
THE FORECOING RESOLUTION is approved and adopted by
the City Councilor the City of Anaheim this 19th day of
December 197 8 .
