RESOLUTION NO. 78R- 768
A RESOLtlTION OF 1'HE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN A~REEMENT $ETWEEN THE CITY OF ANAHEIM
AND EMKAY BUSINE$S CENTRE/ANAHEIM, A JOINT
VENTURE, AND AUT~ORIZING THE MAYOR AND CITY
CLERK T() EXECUTE SAID AGREEMENT.
WHEREAS, Emkay B\Jsiness Centre/Anaheim, a joint
venture Chereinaf;:er "Emk.ay."> is dev.eloPin.g the property on
the north of Oran wood AvEtnue and east of Anaheim Boulevard
within the City 0 Anaheim and is preparing plans for the
installation of s~wer, wat~r, storm drain and street improve-
ments adjacent to said devEtlopment; and
WHEREAS. the City of Anaheim has an obligation for
a portion of theatreet improvements along Orangewood Avenue
and the extension of the storm drain within Santa Cruz Street
from Orangewood A~enue to a point 223 feet northerly of
Orangewood Avenue; and
WHEREAS, the City and Emkay consider it is in the
best interests of ~conom1ca and public safety to combine
said improvements into one project; and
WHEREAS, an agre~ment has been prepared, the terms
and conditions of which are satisfactory to the City of
Anaheim.
NOW, THQREFORE, ijE IT RESOLVED by the City Council
of the City of An~eim that the terms and conditions of an
agreement between 'the City of Anaheim and Emkay relating to
the installation of certain public improvements be, and the
same are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are ~reby, a~thorized and direc.ted td execute
said agreement fo~ and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by
the City Council of the City of Anaheim this 5th ~ay of
December , 1918.
