VERMONT-LEMON IINTERCEPTOR SEWER IMPROVEMENT, IN
THE CITY OF A~HEIM, ACCOUNT NO. 46-790-6325-0070.
WHEREAS, the ~itY Council of the City of Anaheim did
cause to be published i,n a news,paper of general circulation,'
printed, published an circulated in the City of Anaheim, to
wit: The Anaheim Bul,etin, on the 28th of September and 5th
, of October. 1978. j a notice inviting sealed propo,sals
for furnishing the fo~1owing:
All plant, labor, !services, materials and equipment, and
all utilities and!transportation, including power, fuel
and water, and pe~forming all work necessary to construct
and complete in a!good and workmanlike manner, in strict
accord,ance with tIi.,',~ specifications, plans and drawings
therefor on file ~n the Office of ,the City Engineer or
City Clerk of the1City of Anaheim, the following public
improvement, to w~t:
Vermont-Lemon Int~rceptor Sewer Improvement, in the City
of Anaheim, consi~ting of the construction of approxi-
mately 10,057 L.F~ of 8", 10", 12", 18", 21" and 24"
V.C.P. sewer inc1~ding manholes, drop manholes, manhole
removal and remod~l, jacking of steel casing, sewer
siphon, special s~ructures, house laterals, excavation,
resurf'acing of' exllsting pavement, protecting of' exist-
ing improvements rmd utility lines, construction of 4",
6ft and 12ft c.r.p. domestic water' facilities and appur-
tenant work as sh~wn on the plans and delineated in the
specifications on; file in the Office of the City Engineer,
Account No. 46-790-6325-0070,

of said public improv ment on file in the Office of the City
Clerk of the City of , aheim; and

WHEREAS, said notice inviting sealed proposals for said
public' improvement di. provide that sealed proposals would be
received by the City ~f Anaheim at the Office of the City Clerk
of the City of Anahei* up to the hour of 2:00 o'clock P.M. on
the 19th day of Oqtocer , 19 78 , for the furnishing
of all plant, labor, $ervices, materiars-and equipment, all
utilities and transpottation, including power, fuel and water,
and performing all wotk necessary to construct and complete in
a good and workmanlik+ manner, the public improvement herein-
above more particu1arty mentioned and described, and which
notice did state and feclare that pursuant to the provisions
of Section 1770 of th+ Labor Code, the City Council of the City
of Anaheim had ascert.ined the prevailing rate of wages in the
locality in which thi$ type of labor is to be performed for
each craft or type of'workman or mechanic needed to execute the
contract, and which wfge scale is on file in the Offices of the
City Clerk and City E*gineer; and '
WHEREAS, the ~ity Clerk of the City of Anaheim did
receive the followingisealed proposals prior to 2:00 o'clock
P.M. on the 19th dair of October , 19 78 , in
response to the notict aforesaid inviting sealed proposals,

and tabulate said se~ed proposals and did report to the City
Council the result of! his examination and tabulatio~; and

of the City Clerk o~ the City of Anaheim, the public improvement
hereinabove mention~d and described, together with the appurten-
ances thereto, and ~s specified in the notice inviting sealed
proposals, and that; said proposal of said above-named bidder
should be accepted ~nd a contract awarded to said bidder in
accordance therewith; and

WHEREAS, tht' City Co~ncil finds that the above-mentioned
sealed proposal is he lowest responsible proposal receiv, ed and
that the person, fi or corporation submitting said proposal
is a responsible person, firm or corporation and that the pro-
posal submitted is ~he best suited and fitted for the public
improvement to be c~nstructed.
NOW, THEREF~RE, BE It RESOLVED by the City Council of
the City of Anaheim!'.,t, hat the, sealed proposal submitted by said
contractor for the ~rnishing of all plant, labor. services,
materials and equip ent, all utilities and transportation,
including power, fu 1 and water, and performing all work
necessary to constr~ct and complete, in a good and w~rkmanlike
manner, in strict atcordance with the specifications, plans and
drawings therefor 0* file in the Office of the City Clerk of the
City of Anaheirn~nrl!the notice invitine Realed proposals, the
public works and im,rovement hereinabove more particularly men-
tioned and describe~, together with the appurtenances thereto,
be, and the same is'hereby, accepted, and that a contract for the
construction and co*pletion of said public improvement be, and
the same is hereby, : awarded to the said above-named bidder.
AND BE IT FtRTHER RESOLVED that the successful bidLer
or bidders upon eac~ contract awarded as hereinabove set forth,
shall be, and they *re hereby required to execute a contract in
the required form with the City of Anaheim upon the terms and
conditions specifie4t in the notice inviting sealed proposals and
the proposal submitted by said successful bidder or bidders nnn
in accordance with the plans and specifications for said puhUc
improvement hereina.ove described, and in accordance with the
terms, conditions a$d provisions of this resolution, and that
said successful bid~er or bidders to whom each contract is awarded
shall be required t~ furnish a surety bond in an amount equal to
one hundred per cent (100%) of the contract price for all labor,
materials and equip*ent to be furnished and performed, as set
forth in the sealed'proposal submitted by said bidder for the
construction of sai~ public improvement, together with the appur-
tenances thereto or such portion thereof as is covered by said
contract, as security for the faithful performance of said contract,
and a separate surety bond in an amount equal to one hundred per
cent (100%) of the ~onstruction cost of said public improvement
covered by said contract, as security for the payment of all
persons performing tabor and furnishing material for said project.

AND BE IT ~FURTHER RESOLVED that said successful hidder
or bidders be, and ~ey are hereby, required to furnished to the
City of Anaheim in qompanies satisfactory to the City of Ana~eim,
public liability, p~perty damage, compensation, and other insur-
ance in the amounts jand for the purposes set forth and specified
in the notice invit~ng sealed proposals, and subject to the
approval of the Cit~ Attorney as to form and sufficiency.
AND BE IT iFURTHER RESOLVED that the Mayor and the City
Clerk of the City ofl Anaheim be, and they are hereby, authorized
and directed to mak~!' execute and enter into, for and on behalf
of the Ci~y of Anah im, a 'o1ritten contract with said successful
bidder or bidders f :If the fu.rnishing of all plant, labor', mater-
ials, and equipment ~nd performing all work, as hereinabove more
particularly descri~d, for the construction, installation and
completion of said Rublic improvement hereinahove described Upon
the terms and condi~ions as specified in the notice inviting .

and general specifiqations and detailed specifications and draw-
ings, and all adden~ thereto, and a11modificati6ris incorporated
therein prior to th~ date of the opening of bids, on file in the
Office of the City qlerk of the City of Anaheim 'and in strict
accordance with the terms, conditions and provisions of this reso-
lution, and in acco~ance with all of the contract documents herein
specified.
THE FOREGqING RESOLUTION is approved and adopted bv the
