RESOLUTION NO. 78R-723 A RESOLUTIQN OF THE CITY COUNCIL OF THE CITY OF ANftHEIMGRANTING CONDITIONAL USE PERMIT NO . 1 9 , . t WHEREAS, t~e City Planning Commission of the City of Anaheim did receive ~n application for a conditional use permit from DALE E. AND SARAjH ANN FOWLER, owners; and CREVIER IMPORTS, INC., agent, to permi.t an automobile sales, service and restora- tion facility on certain real property situated in the City of Anaheim, County of Orange, State of Californi.a, de.scribed as: That portion of Lot 20 in Block K of the Kraemer Tract, as shown on a Map recorded in book 12, pages 78 and 88 of Mis~ellaneous Records of Los Angeles County, Californda, described as follows: Parcel No. 2 as shown on a Map filed in book 55, page 47 of Parcel Maps in the office of the County Recorder of Orange County" California; and /.-", .." -1- ATTY-26 (Page 1 of 3 pages) r-, ~ WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of ~hich public hearing were duly given as re- quired hy law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code~ and ,A''-'' WHEREAS, s~id Commission, after due inspection, investi- gation and studies m~e by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolut+ion No. PC78-226, granting Conditional Use Permi't No. 1~B9 ~ and MIEREAS, t~reafter, within the time prescribed by law, an interested party ~ the City Council, on its own motion, caused the review of said Pl~nning Commission action at a duly noticed public hearing~ and WHEREAS, at the time and place fixed for said public hearing, the City Coupcil did duly hold and conduct such hearing and did give all pers~s interested therein an opportunity to be heard and did receive evidence and reports1 and WUEREAS, th~ City Council finds, after careful consider- ation of the recommenaationsof the City Planning Co~i$s.ion and all evidence and repo~ts offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authori~ed by the Anaheim Municipal Code. 2. The proposea use will not adversely affect the adjoining land uses and the gro.th and development of the area in which it is proposed to be located. 3. The size an. shape of the site proposed for the use is . adequate to allow the full development of the proposed use in a manner not detrimental to the particular,area nor to the peace, health, safety and ge'eral welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden .pon the streets and highways designed and improved to carry the traffic in the area. 5. The grantin9 of the conditional use permit under the conditions imposed wi~l not be detrimental to the peace, health, safety and general we1fare of the citizens of the City of Anaheim. .~ NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim tijat the action of the City Planning Commission ~ranting said conditional use permit be, and the same is here y, modified and that Conditional Use Permit No. 1889 be, and the same is hereby, granted permitting an automobile sales, service and restoration facility on the hereinabove described prop- erty, subject to the fOllowing conditions: --2- ATTY-26 (Page 2 of 2 Pages) .r- .-, ,~ I 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked EXhibit Nos. 1 through 3. 2. That Condition No.1, above mentioned, shall be complied with prior to final building and zoning inspections. 3. That there shall be no on-site signs advertising auto- mobiles for sale on the subject property. 4. That all 'Work on, storage and sales of automobiles shall be conducted wholly' inside the building. 5. That the use of said property shall be limited to a sales, service and restoration facility for Ferrari and Maserati auto- mobiles only. 6. That the use, as granted, is permitted for a period of approximately twenty (20) months to expire May 22, 1980 unless an extension of time i$ granted in conjunction with Conditional Use Permit No. 1837. TJ.I!at said time limitation is to determine whether the use has had a detrimental effect on the area; and thatexten- sions of time may be granted by the City Council upon written re- quest by the petitioner, fOllowing a determination that the use has not had a detrimental effect. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such Conditional Use Permit for good cause or failure of said owners, their heirs, successors or assigns to comply with the !naheim Municipal Code and regulations and the conditions therein.
