RESOLUTION NO. 78R- 711
A RESOLqTION OF THE CITY COUNCIL OF THE CITY
OF AN~IM APPROVING THE TERMS AND CONDITIONS
OF AN AQREEMENT WITH THE MUNICIPAL WATER DISTRICT
OF ORANqE COUNTY IN CONNECTION WITH LEASING
CAPACITY IN THE DIEMER INTERTIE PROJECT AND
AUTHORI~ING AND DIRECTING THE UTILITES DIRECTOR
TO EXECUTE SAID AGREEMENT.
WHEREAS~ Municipal Water District of Orange County
("MWDOCtt) is the qwner and lessee of certain real property.
easements and lic~nses situated in the County of Orange and
has obtained per~ts to construct public improvements in
certain public stJteets and public rights-of-way in the state
of California (he:.reinafter referred to as the "Property"); and
WHEREASMWDOC, the City of Anaheim, and other
governmental agen4ies desire to construct water transmission
pipelines, appurtEtaances and appurtenant works (hereinafter
referred to as thEt "Facilities") on the Property; and
WHEREAS, MWDOC has caused to be prepared and will
approve plans and. specifications for the construction of the
Facilities, all to be constructed on the Property; and
WHEREASt the Facilities are to be constructed to
provide a water s$pply to MWDOC, the City of Anaheim and other
participating pUblic entities; and
WHEREAS, pursuant to an agreement by and between the
City of Anaheim ~d MWDOC, entitled "Agreement for Construc-
tion, Operation a$d Maintenance of Pipeline and to Enter Into
Sublease Concerni'~ the Diemer Filtration Plant/Santiago
Aqueduct Intertie~ as amended (hereinafter referred to as the
"Agreement"). the. City of Anaheim desires to lease from MWDOC
capacity in the F,cilities upon terms and conditions substan-
tially as set forth in the Agreement and a Sublease; and
WHEREAS. an agreement entitled "Diemer Intertie
Sublease" has bee~ prepared, the terms and conditions of which
are acceptable to. the City Council of the City of Anaheim.
NOW, Tl$REFORE, BE IT RESOLVED that the terms and
conditions of said Sublease are hereby approved and accepted.

BE IT FURTHER RESOLVED that the Utilities Direct.or
be. and he is hereby, authorized and directed to execute said
Sublease on behalf of the City of Anaheim.
