78-709 r- ,- RESOLUTION NO. 78R-709 , ,...-..., A RESOLUTJON OF TH~ CITY COUNCIL OF THE CITY OF ANAHEI' FINDING AND DETERMINING THAT TITLE 18 OF THE', ~AHEIM -.mNICIPAL CODE RELATING TO ZONING SH4>VLD BE Al\!ENDED AND THAT THE BOUND- ARIES OF tERTAIN Z~NES SHOULD BE CHANGED. WHEREAS, ~he City Planning Commission of the City of Anaheim did hold a ,~blic he.ring in Reclassification Proceedings No. 78-7q-4~O consi.er an amendment to Title 18 of the Anaheim Municipal C~~e relating to zoning, and to consider a change in the bound_ties of the zone or zones hereinafter men- tioned and describe4and, at said hearing, did receive evidence and reports from petsons interested therein and from its staff: and WHEREAS, ,ithin a period of forty (40) days following said hearing, the P~.nning C~mmission did duly adopt a resolution containing a report~f its findings, a summary of the evidence presented at said h.aring and approved the proposed amendment: and WHEREAS, tbereafte~, within the time prescribed by law, an interested party~r the City Council, on its own motion, caused the review of said 'lanning Commission action: and WHEREAS, at the ti~e and place fixed for said public hearing, the City C4~cil did duly hold and conduct such hearing and did give all pet,ons interested therein an opportunity to be heard and did recei.e evidenee and reports, and did consider the same: and WHEREAS, t~e City Council does find and determine that the amendment to Ti~te 18 of the Anaheim Municipal Code should be adopted and that th~property hereinafter described should be excluded from the zc)1!le or zones in which it is now situated and incorporated in the ~one or zones as hereinafter set forth. That the owner(s) of subject property shall pay to the City of Anaheim the appropriate fee as determined by the City for street lighting purposes along Lincoln Avenue. 2. That the owner(s) of subject property shall pay to the City of Anaheim the awpropriate fee as determined by the City for tree planting purpose$. 3. In the event that suoject property is to be divided for the purpose of sale, l~ase or financing, a parcel map, to record the approved division of subje~t property, shall be submitted to and approved by the City of Anaheim and then be recorded in the Office of the Orange C~unty Reeorder. 4. That the owner(s) of subject property shall pay to the City of Anaheim the ap~ropriat~ park and recreation in-lieu fees, as determined to be appropriat~ by the City Council, said fees to be paid at the time the building permit is issued. 5. That the owner(s) of subject property shall pay the traf- fic signal assessment tee (Council POlicy No. 214) amount or $36.00 per each new dwelling unit prior to the issuance of a building permit. 6. That prior t~ the iS$uance of a building permit, specific landscaping plans for the ten (10) foot setback area between the seven (7) foot block wall along the north, east, and west property lines and the six (6) toot wooden fence enclosing the private patios shall be submitted to the Planning Department for review and ap- proval; that said landscaping shall provide a dense and visually effective plant buffer within two (2) years of planting, and that said landscaping buffer shall minimally consist of broad-headed trees planted twenty (20) feet on centers and interspersed with bushes. 7. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to commencement of structural framing. 8. That no driveway onto Lincoln Avenue shall be located closer than 25 feet tdthe east property line and that the precise location shall be subject to the approval of the City Traffic Engineer. ~---..." 9. That a seven (7) foot high masonry wall shall be construc- ted along the north property line and those portions of the east and west property lines which abut RS-7200 and RS-A-43,000 zoning. 10. That the twenty (20) foot wide structural setback between the proposed apartment project and the adjacent RS-7200 and RS-A-43,000 zoning to the north, east, and west shall consist of (a) a ten (10) foot wide densely landscaped area adjacent to the residential zoning and (b) enclosed ten (10) foot deep private patios adjacent to the apartments; that the private patios shall be fully enclosed by six (6) foot high wooden fences; that access to the landscaped area shall be prohibited except for purposes of mainten- ance; and that locked gates to the landscaped area shall be instal- led only where necessary to provide access for maintenance purposes. -3- ~ -, 11. That sidewalks shall be installed along Lincoln Avenue as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. /.-"", 12. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Pub- lic Works. 13. That subject property shall be served by underground utilities. 14. That drainate of sub~ect property shall be disposed of in a manner satisfactory to the City Engineer. 15. That sUbject. property shall be developed precisely in accordance with plans and specifications on file with the City of Anaheim marked Revision No.2 of Exhibit No.1 and Revision No.1 of Exhibit Nos. 2 and 3; provided, however, that all dwelling units located adjacent to the north and east property lines shall be one- bedroom units only. 16. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1, 2a.nd 3, above-mentioned, shall be com- pleted. The provisionS or rights granted by this resolution shall become null and void by action of the City Council unless said con- ditions are complied with within one year from the date hereof, or such further time as the City Council may grant. 17. That Condition Nos. 8, 9, 10, 11, 12, 13, 14 and 15, above-mentioned, shall be complied with prior to final building and zoning inspections. BE IT FURTH!R RESOLVED that Resolution No. 78R-611 be, and the same is hereby, repealed. BE IT FURTH!R RESOLVED that the City Attorney be, and he is hereby, authori~~d and directed to prepare and submit to the City Council an oJ!l<ftinance $,mending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
