all utilities andltransportation, including power, fuel
and water, and pet forming all work necessary to construct
and complete in a,good and workmanlike manner, in strict
accordance with t'e specifications, plans and drawings
therefor on file in the Office of the City Engineer or
City Clerk of thejCity of Anaheim, the following public

WHEREAS, sai4 notice inviting sealed proposals for said
public. improvement d~d provide that sealed proposals would be
received by the City lof Anaheim at the Office of the City Clerk
of the City of Anahe' up to the hour of 2:00 o'clock P.M. on
the ~ day of tober , 19 78 , for the furnishing
of arrpTant, labor, ,serv1ces, materiaISand equipment, all
utilities and transp~tation, including power, fuel and water,
and performing all w?jrk necessary to construct and complete in
a good and workmanli~ manner, the public improvement herein-
above more particulari,ly mentioned and described, and which
notice did state and ideclare that pursuant to the provisions
of Section 1770 of t~ Labor Code, the City Council of the City
of Anaheim had ascert~ined the prevailing rate of wages in the
locality in which thif type of labor is to be performed for
each craft or type of: workman or mechanic needed to execute the
contract, and which $ge scale is on file in the Offices of the
City Clerk and City E~gineer; and .
WHEREAS, the Pity Clerk of the City of Anaheim did
receive the fOllOWing!~Sealed proposals prior to 2:00 o'clock

hereinabove mentioqed and described, together with the appurten-
ances thereto, and ,as specified in the notice inviting sealed
proposals, and thaq said proposal of said above-named bidder
should be accepted 'and a contract awarded to said bidder in
accordance therewi~h; and

WHEREAS, .t~e City Council fin?s that the 'above-~entioned
sealed proposal 1S ithe lowest respons1ble proposal rece1ved and
that the person, f~tm or corporation submitting said proposal
is a responsible p~son, firm or corporation and that the pro-
posal submitted is it he best suited and fitted for the public
improvement to be qanstructed.
NOW, THEREFQRE, BE IT RESOLVED by the City Council of
the City of Anahei~ that the sealed proposal submitted by said
contractor for the ~urnishing of all plant, labor, services,
materials and equip~ent, all utilities and transportation,
including power, f~l and water, and performing all work
necessary to constr~ct and complete, in a good and workmanlike
manner, in strict a~cordance with the specifications, plans and
drawings therefor on file in the Office of the City Clerk of the
City of Anaheim~nrlj the notice invitinE sealed proposals, the
public works and improvement hereinabove more particularly men-
tioned and describetl, together with the appurtenances thereto,
~e, and the same is. hereby, accepted, and that a contract for the
construction and co~letion of said public improvement be, and
the same is hereby, awarded to the said above-named bidder.

AND BE IT FURTHER RESOLVED that the successful bid~er
or bidders upon eac~ contract awarded as hereinabove set forth,
shall be, and they ~re hereby required to execute a contract in
the required form w~th the City of Anaheim upon the terms and
conditions specifie~ in the notice inviting sealed proposaJ.s and
the proposal submitted by said successful bidder or bidders nnn
in accordance with t:he plans and specifications for said puhlic
improvement hereina~ove described, and in accordance with the
terms, conditions a~d provisions of this resolution, and that
said successful bid~er or bidders to whom each contract is awarded
shall be required t~ furnish a surety bond in an amount equal to
one hundred per cent (100%) of the contract price for all labor,
materials and equip~ent to be furnished and performed, as set
forth in the sealed:proposal submitted by said bidder for the
construction of sai~ public improvement, together with the appur-
tenances thereto or such portion thereof as is covered by said
contract, as security for the faithful performance of said contract,
and a separate surety bond in an amount equal to one hundred per
cent (100%) of the ~onstruction cost of said public improvement
covered by said contract, as security for the payment of all
persons performing labor and furnishing material for said project.

AND BE IT.rURTHER RESOLVED that said successful hidder
or bidders be, and ~ey are hereby, required to furnished to the
City of Anaheim in ~ompanies satisfactory to the City of Ana~eim,
public liability, ptoperty damage, compensation, and other insur-
ance in the amounts 'and for the purposes set forth and specified
in the notice invit~ng sealed proposals, and subject to the
approval of the City Attorney as to form and sufficiency.
AND BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City o. Anaheim be, and they are hereby, authorized
and directed to mak~, execute and enter into, for and on behalf
of the City of Anah~im, a written contract with said successful
bidder or bidders fqr the furnishing of all plant, labor, mater-
ials, and equipmentJand performing all work, as hereinabove more
particularly descri~.d, for the construction, installation and
completion of said pUblic improvement hereinahove described upon
the terms and condi~ions as specified in the notice inviting
sealed proposals, t~ detailed design, plans, profiles, drawings
and general specifiqations and detailed specifications and draw-
ings, and all adden~ thereto, and all modifications incorporated
therein prior to th~ date of the opening of bids, on file in the
Office of the City dlerk of the City of Anaheim and in strict
accordance with the ~erms, conditions and provisions of this reso-
lution, and in acco~ance with all of the contract documents herein
specified.
