A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING THE TERMS AND CONDITIONS
OF AN AGREEMENT WITH THE STATE OF CALIFORNIA
�,,.,.. (DEPARTMENT OF TRANSPORTATION) AND AUTHORIZING
AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE SAID AGREEMENT. (DISTRICT AGREEMENT
NO. 3564 - MAGNOLIA STORM DRAIN)
WHEREAS, there exists an uns :tisfactory drainage condi-
tion on Magnolia Avenue in the City of Anaheim, which has resulted
in or may result in flooding of the aforesaid area; and
WHEREAS, the City will undertake construction of an un-
derground storm drain in Magnolia Avenue; and
WHEREAS, the City will benefit from the aforesaid con-
struction project through correction of the drainage problem at
the aforesaid intersection and the extent of the City's participa-
tion in the construction of the project is reasonably proportioned
to said benefit; and
WHEREAS, the State of California is willing to bear a
proportionate cost in connection with the construction project;
and
WHEREAS, the State and the City mutually desire to
cooperate and jointly participate in the aforesaid construction
project; and
WHEREAS, an agreement (District Agreement No. 3564) has
been prepared, the terms and conditions of which are acceptable to
the City Council of the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED that the terms and condi-
tions of said agreement are hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized and directed to execute said
agreement on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 12th da of August,
1980. '
