80R-359 RESOLUTION NO. 80R-359 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING AREA DEVELOPMENT PLAN NO. 108, EXHIBIT E. WHEREAS, on August 3, 1971, the Anaheim City Council approved Area Development No. 108, Exhibit "D," Modified, regarding vehicular access generally bounded by Kraemer Boulevard on the east, La Palma Avenue on the north, and the Riverside Freeway on the south; and WHEREAS, on April 21, 1980, the petitioner (M. W. Ranill, Realty World- Ranill Realty) requested amendment to Area Development Plan No. 108 to delete a portion of La Mesa Avenue located in unin- corporated Orange County, west of White Star Avenue and north of the Riverside Freeway, in order to allow development of an industrial complex; and WHEREAS, said requested amendment to Area Development Plan No. 108 has heretofore been given the designation of Exhibit "E" to said Plan; and WHEREAS, the Planning Commission has recommended that said proposed amendment to Area Development Plan No. 108, Exhibit "E" be denied; and WHEREAS, the City Council did hold a public hearing at the Council Chambers of the Anaheim Civic Center on August 12, 1980, at 3:00 p.m., notice of said hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, to hear and consider evidence for and against said proposed area development plan amendment and to investigate and make findings and recommendations in connection therewith; and WHEREAS, the City Council, after due investigation and study, made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the subject property is an irregularly- shaped parcel of land consisting of approximately 80.0 acres bounded on the north by La Palma Avenue, on the east by Kraemer Boulevard, and on the south and west by the Riverside Freeway. 2. That on June 28, 1971, the Planning Commission recommended adoption of Area Development Plan No. 108, following a public hearing, notice of said public hearing having been duly given as required by law. 3. That Area Development Plan No. 108, establishing a col- lector and local street circulation pattern for subject area, was approved by the City Council on August 3, 1971. Subject plan extended Blue Gum Street, retained White Star Avenue, added Armando Street, abandoned Canal Street and provided a new frontage road (La Mesa Avenue) . -1- 4. That La Mesa Avenue is presently improved from Blue Gum Street easterly to the Anaheim City Limits and serves an existing industrial complex. 5. That the portion of La Mesa Avenue being considered for deletion by this amendment is located between the Anaheim City Limits and the southerly terminus of White Star Avenue. Said portion of White Star Avenue has not been improved and the adjacent property to the north has not been developed. 6. That other property owners in the immediate area have developed their properties in accordance with Area Development Plan No. 108, as approved in 1971, with a frontage road (La Mesa Avenue) and that deletion of La Mesa Avenue would create hardships for those properties with existing freeway exposure. 7. That the City Council has determined that Amendment to Area Development Plan No. 108, Exhibit E, is inappropriate at this time and no change should be made to the existing plan. NOW, THEREFORE, BE IT .RESOLVED that the City Council has reviewed the proposal to amend Area Development Plan No. 108, encom- passing an irregularly- shaped parcel of land consisting of approxi- mately 80.0 acres bounded on the north by La Palma Avenue, on the east by Kraemer Boulevard, and on the south and west by Riverside Freeway, to delete the portion of La Mesa Avenue located in unincor- porated Orange County west of White Star Avenue and north of the Riverside Freeway in order to develop certain property with an industrial complex; and does hereby approve the Negative Declaration from the requirement to prepare an environmental impact report on the basis that there would be no significant individual or cumula- tive adverse environmental impact due to the approval of this Negative Declaration; that no sensitive environmental impacts are involved in the proposal; that the Initial Study submitted by the petitioner indicates no individual or cumulative adverse environ- mental impacts; and that the Negative Declaration substantiating the foregoing findings is on file in the Anaheim City Planning Department. BE IT FURTHER RESOLVED, that pursuant to the foregoing findings, the City Council does hereby deny an amendment to Area Development Plan No. 108, Exhibit "E" and orders no change to the current Plan on the basis of the foregoing findings.
