2005-020RESOLUTION NO. 2005- 20 A RESOLUTION OF CITY COUNCIL OF THE CITY OF ANAHEIM, CALIFORNIA, MAKING APPLICATION TO AND REQUESTING THE LOCAL AGENCY FORMATION COMMISSION OF ORANGE COUNTY TO TAKE PROCEEDINGS PURSUANT TO THE CORTESE-KNOX-HERTZ.BF,RG LOCAL GOVERNMENT REORGANIZATION ACT OF 2000 FOR THE CITY OF ANAHEIM TO ANNEX APPROXIMATELY 495 ACRES OF PROPERTY WITHIN ITS SPHERE OF INFLUENCE, AND FILE ANNEXATION N0.287 WHEREAS, City of Anaheim ("City") desires to initiate proceedings pursuant to the Cortese-Knox-Hertzberg Local Reorganization Act of 2000, Division 3, commencing with Section 56000 of the Government Code, for the annexation of unincorporated territory to the City; and WHEREAS, the City will file an application with the Local Agency Formation Commission to annex unincorporated territory referred to as Areas 4-AN-6, 4-AN-7 and 4-AN-8, as set forth in Exhibit 1, attached hereto and by this reference incorporated herein; and WHEREAS, the proposed annexation areas are within the City's Sphere of Influence; and WHEREAS, the proposed annexation shall be subject to the following terms and conditions: the annexation shall be consistent with Government Code Section 56886 and other applicable law existing as of the date of the filing of this Resolution; and WHEREAS, the reasons for this proposed annexation are as follows: to increase the economy and efficiency of government services as well as coordination of urban planning efforts and enhancement of community identity; and WHEREAS, City and LAFCO staff held a workshop on February 23, 2005 and will hold future workshops on March 16, 2005 and March 31, 2005 for the residents and property owners to address any concerns about the proposed annexation. The major questions of the residents and property owners were how the proposed annexation would affect their property and delivery of services. LAFCO and City staff assured the property owners the annexation into Anaheim would be a seamless transition; and WHEREAS, a Public Hearing will be held by the Anaheim Planning Commission on April 4, 2005, and by the Anaheim City Council on April 12, 2005, to consider amending the Land Use Element of the General Plan and to reclassify zone designations. Notices will be mailed to all property owners within a radius of 300 feet from the boundaries within the proposed annexation areas; and WHEREAS, the City and the Municipal Water District of Orange County ("MWDOC") are member agencies of the Metropolitan Water District of Southern California ("MWD") and any annexation of territory to one MWD agency shall be accompanied by a concurrent detachment from the other. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Anaheim, California, does hereby approve the Resolution of Application for Annexation No. 287, and requests the Loeal Agency Formation Commission of Orange County take proceedings for the annexation of territory to the City as shown in Exhibit 1, attached hereto and incorporated herein by this reference, according to the terms and conditions stated above and in the manner provided by the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000.
