A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING SUBMITTAL OF AN APPLICATION
FOR AND ACCEPTANCE OF A USED OIL RESEARCH,
TESTING AND DEMONSTRATION GRANT FROM THE
CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD
FOR FISCAL YEARS 2005/2006 THROUGH 2008/2009 AND
AUTHORIZING THE FIRE CHIEF TO TAKE ANY AND ALL
ACTIONS NECESSARY TO OBTAIN THE GRANT AND
IMPLEMENT THE PROGRAM
WHEREAS, the People of the State of California have enacted the California Oil
Recycling Enhancement Act of 1991 that provided funds to cities and counties for establishing and
maintaining local used oil management programs that encourage recycling or appropriate disposal
of used oil and household hazardous waste; and
WHEREAS, the California Integrated Waste Management Board (Board) has been
delegated the responsibility for the administration of the Used Oil Recycling Research, Testing and
Demonstration grants within the State, including setting up necessary procedures governing
applications for grants by cities and counties; and
WHEREAS, the procedures established by the Board require an applicant to certify,
by resolution, approval of an application prior to submittal of such application to the state; and,
WHEREAS, the City wishes to submit an application for fiscal years 2005/2006
through 2008/2009 for a Used Oil Research and Development Grant, the proceeds of which will be
used to develop a program to educate target areas within the City of Anaheim of the proper disposal
of used oil and filters, and to enter into related agreements with the State of California for
enhancement of the Used Oil and Household Hazardous Waste Recycling Program (Program) for
the City of Anaheim.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The Fire Chief of the City of Anaheim is hereby authorized to submit an annual grant
application on behalf of the City to the California Integrated Waste Management Board for a Used
Oil Research, Testing and Demonstration (4th Cycle) Grant, commencing fiscal year 2005/2006
through and including September 30, 2008.
2. The City Council of the City of Anaheim hereby agrees to, and by this resolution,
does accept such Used Oil Research, Testing and Demonstration (4th Cycle) Grant, as may be
awarded to the City by the California Integrated Waste Management Board, of up to Three Hundred
Thousand Dollars ($300,000.00), commencing fiscal year 2005/2006 and concluding September 30,
2008, without further action of the City Council being required therefor.
3. The City of Anaheim hereby agrees to comply with each and all of the terms,
conditions and limitations imposed by the grantor upon said Grant, and the Fire Chief is hereby
authorized and directed to execute any agreements, assurances, or other documents as may be
necessary in connection with submitting and accepting the Grant and implementing the Program.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City
of Anaheim this 1st day of March , 2005, by the following roll call vote:
