A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE EXE-
CUTION OF AN EXTENSION RIDER, DESIGNATED C.L.D.
NO. 10833 -11, EXTENDING THE TERM OF THAT CERTAIN
AGREEMENT MADE AND ENTERED INTO WITH THE LOS
ANGELES AND SALT LAKE RAILROAD COMPANY - UNION
PACIFIC RAILROAD COMPANY DATED NOVEMBER 30, 1951
AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXE-
CUTE SAID AGREEMENT ON BEHALF OF THE CITY OF
ANAHEIM.
WHEREAS, an agreement was heretofore entered into by and
between the City of Anaheim and the Los Angeles and Salt Lake Rail-
road Company - Union Pacific Railroad Company dated November 30,
1951, covering power line encroachment and crossings; and
WHEREAS, said agreement (by latest extension) will expire
on December 2, 1980, and it is the desire of the parties to said
agreement to extend the same for a term of ten (10) years ending
December 2, 1990, upon the same terms and conditions as set forth
in said agreement and amendments and supplements thereto, if any;
and
WHEREAS, the Los Angeles and Salt Lake Railroad Company -
Union Pacific Railroad Company has this day submitted to the City
Council an extension rider, designated C.L.D. No. 10833 -11, to be
made and entered into by and between said railroad companies and
the City of Anaheim extending the term of said agreement to and
including December 2, 1990, upon the same terms and conditions as
set forth in the agreement dated November 30, 1951, and any amend-
ments and supplements thereto, which rider the City Council finds
to be acceptable.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of
the City of Anaheim that the extension rider, designated C.L.D. No.
10833 -11, this day submitted to the City Council to be entered into
by and between the City of Anaheim and the Los Angeles and Salt
Lake Railroad Company - Union Pacific Railroad Company, extending
the term of that certain agreement entered into by and between the
City of Anaheim and said railroad companies dated November 30,
1951, to and including December 2, 1990, upon the same terms and
conditions as set forth in said agreement and any amendments and
supplements thereto, be and the same is hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be,
and they are hereby, authorized to execute said extension rider for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 30th day of September, 1980.
