80R-470 RESOLUTION NO. 8nR -470 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 2102 , . WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a conditional use permit from CHERYL JO MATLOCK, owner, and LYNN L. MATLOCK, agent, to permit a one lot, sixty (60) unit condominium complex on certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: Parcel 1: The Northerly 98 feet of the Northerly 5 acres of the following: The East half of the North- east quarter of, the Southeast quarter of Section 14, in Township 4 South, Range 11 West, San Bernardino Base and Meridian;. Excepting therefrom said East half of the Northerly 679.46 feet thereof; Excepting from said North - erly 98 feet the Easterly 40 feet thereof as granted to the State of California by deed recorded March 1, 1951, in Book 2151, Page 448, Official Records in the office of the County Recorder of said Orange County; Also excepting from said Northerly 98 feet the Westerly 270 feet thereof. Parcel 2: The Easterly 9.5 feet of the Westerly 279.5 feet of the Northerly 5 acres of the following: The East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, S.B.B. &M. Excepting therefrom the Northerly 679.46 feet of said East one -half; 'Excepting from the Easterly 9.5 feet the Northerly 95 feet; Parcel 3: The Southerly 10 feet of the Northerly 105 feet of the Easterly 170 feet of the Northerly 5 acres of the following: The East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, S.B.B. &M. -1- ATTV -26 (Paso 1 of 2 Pagan) Excepting from said East one -half the Northerly 679.46 feet thereof. Excepting from said Southerly 10 feet of the Easterly 40 feet thereof as granted to the State of California by deed recorded March 1, 1951, in Book 2151, Page 448, Official Records, in the office of the County Recorder of said Orange County. Parcel 4: The Westerly 270 feet of the Northerly 5 acres of the following: The East one -half of the Northeast quarter of the Southeast quarter of Section 14, Township 4 South, Range 11 West, San Bernardino Base and Meridian; Excepting therefrom the Northerly 679.46 feet of said East one -half. -la- WHEREAS, the City Planning Commission did hold a public hearing upon said application at the City Hall in the City of Anaheim, notices of which public hearing were duly given as re- quired by law and the provisions of Title 18, Chapter 18.03 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. pr80 - 117 , approving Conditional Use Permit No. 2102 ; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a duly noticed public hearing; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consider- ation of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a conditional use permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular,area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not im- pose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the conditional use permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission approving said conditional use permit be, and the same is hereby, su area and that Conditional Use Permit No.2102 be, and the same is hereby, granted permitting a one -lot, sixty (60) unit condominium complex on the hereinabove described property subject to the following conditions: —2- ATTY-26 (Page 2 of 2 Pages) STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
