80R-478 RESOLUTION NO. 80R -478 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTIONS NO. 73R -248, 73R -477 AND 74R -524 AND REPEALING RESOLUTIONS NO. 74R -200 AND 74R -209 RELATING TO ZONING RECLASSIFICATIONS. WHEREAS, on June 26, 1973, the City Council did adopt its Resolution No. 73R -248 approving a zoning reclassification in Reclassification Proceedings No. 72 -73 -51 for certain property therein described, which resolution was subsequently amended by Resolution No. 74R -209; and WHEREAS, on October 16, 1973, the City Council did adopt its Resolution No. 73R -477 approving a zoning reclassification in Reclassification Proceedings No. 73 -74 -22 for certain property therein described, which resolution was subsequently amended by Resolution No. 74R -200; and WHEREAS, on October 29, 1974, the City Council did adopt its Resolution No. 74R -524 approving a zoning reclassification in Reclassification Proceedings No. 74- 75 -14; and WHEREAS, the City Council does find it to be in the pub- lic interest and general welfare to amend the conditions of approval as heretofore approved in the aforesaid resolutions, and each of them, in the manner hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the conditions of approval as respectively set forth in Resolution No. 73R -248 as amended by Resolution No. 74R -209, Resolution No. 73R -477 as amended by Resolution No. 74R -200, and Resolution No. 74R -524 be, and the same are hereby, amended in their entirety to read as follows: "1. That dedication shall be made to the City of Anaheim of all streets within the area, according to the Circulation Element of the General Plan, Highway Rights -of -Way, prior to issuance of building permits. 2. That all engineering requirements of the City of Anaheim such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with speci- fications on file in the Office of the City Engineer, at the time the property is developed. -1- 72-73-51 73 -74 -22 74 -75 -14 3. That the owner(s) of subject property shall install street lighting on all streets within the area as required by the Utilities General Manager at the time the property is developed. 4. That electrical utilities shall be placed underground and dedicated to the City of Anaheim in accordance with the require- ments of the Utilities General Manager. 5. That drainage of said property shall be disposed of in a manner satisfactory to the City Engineer. That necessary right -of- way for off -site drainage facilities be dedicated to the City, or that all property owners involved have executed written right -of- way dedication to the City, or that the City Council will have initiated condemnation proceedings for the acquisition of the re- quired drainage right -of -way, the cost of which shall be borne by the developer. The required drainage facilities shall be of a size and type sufficient to carry runnoff waters originating from higher properties south of Santa Ana Canyon Road through said property to ultimate disposal as approved by the City Engineer. Said drainage facilities shall be the first item of construction when the property is developed and shall be constructed and shall be functional throughout that portion of the property being developed and from the downstream boundary of the property to the point of ultimate point of disposal prior to the issuance of any final building inspection or occupancy permits. Drainage district reimbursement agreements may be made available to the developers of said property upon their request. 6. That fire hydrants shall be installed and charged as re- quired and determined to be necessary by the Chief of the Fire Department prior to the commencement of structural framing. 7. That prior to approval of a Final Tract Map, floor plans and elevations for the proposed houses shall be submitted to and approved by the City Planning Commission. In cases where a parcel map is permitted by law, floor plans and elevations for the proposed houses shall be submitted to and approved by the Planning Department prior to issuance of a building permit." BE IT FURTHER RESOLVED that, except as expressly amended herein, Resolutions No. 73R -248, 73R -477 and 74R -524 shall remain in full force and effect. BE IT FURTHER RESOLVED that Resolutions No. 74R -200 and 74R -209 be, and the same are hereby, repealed.
