80R-514 RESOLUTION NO. 80R- 514 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM (A) CERTIFYING FINAL ENVIRONMENTAL IMPACT REPORT NO. 238, (B) MAKING CERTAIN FIND- INGS IN CONNECTION THEREWITH AND (C) ADOPTING A STATEMENT OF OVERRIDING CONSIDERATIONS. WHEREAS, the Anaheim Hilton Joint Venture, a joint venture in partnership form consisting of Wrather Inns, Inc. and Hilton Hotels Corporation, has submitted to the City of Anaheim a proposal for the construction and operation of a hotel having a minimum of 1,500 guest rooms (inclusive of the approximately 500 existing guest rooms at the present Inn at the Park Hotel) and related parking structure which would be located on certain real property owned by the City of Anaheim and known generally as the Anaheim Convention Center property (hereinafter collectively referred to as "Project ") which Project is more specifically de- scribed in Draft Environmental Impact Report No. 238 prepared for the City of Anaheim; and WHEREAS, the City of Anaheim is the lead agency for the preparation and consideration of environmental documents for said Project as defined in the California Environmental Quality Act of 1970, as amended, (hereinafter "CEQA ") and the State of California Guidelines for the Implementation of the California Environmental Quality Act (hereinafter "State Guidelines "); and WHEREAS, the City of Anaheim has prepared, or caused to be prepared, Draft EIR No. 238 and a Supplement thereto ( "Draft EIR ") and has consulted with other public agencies, and the general public and given them an opportunity to comment on said Draft EIR as required by the provisions of CEQA and the State Guidelines; and WHEREAS, on November 18, 1980, a duly noticed public hearing was held by the City Council of the City of Anaheim to provide an opportunity for the general public to comment on and respond to the Draft EIR; and WHEREAS the City of Anaheim has evaluated the comments received from public agencies and persons who reviewed the Draft EIR; and WHEREAS, said comments and recommendations received on the Draft EIR, either verbation or in summary, a list of persons, organizations and public agencies commenting on the Draft EIR, and the responses of the City of Anaheim to significant environ- mental points raised in the review and consultation process have been attached to and made a part of said Draft EIR to form the Final EIR for said Project as required by Section 15146 of the State Guidelines. -1- WHEREAS, said Final EIR has been presented to the City Council of the City of Anaheim for review and consideration prior to the final approval of, and commitment to, said Project. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. That the City of Anaheim does hereby certify that Final EIR No. 238 for said Project has been completed in compliance with CEQA and the State Guidelines and that the City Council of the City of Anaheim has reviewed and considered the information contained in Final EIR No. 238 prior to approval of, or commitment to, said Project. 2. That the City Council of the City of Anaheim does hereby find that said Final EIR identifies the following significant en- vironmental effects of the Project, together with the measures which will be incorporated into said Project to mitigate or avoid said effects: a. Impact: Construction activities will cause an in- crease in noise levels during the estimated two -year period of construction. Mitigation Measures: Construction will primarily be limited to normal daylight working hours. Construction equip- ment will be equipped with noise muffling devices. b. Impact: The Project will cause an increase in air pollution in the area as a result of increased motor vehicle use. Indirect increases in air pollution will result from increased energy consumption. Mitigation Measures: The on -site bus terminal will encourage use of mass transit. Energy conservation measures will reduce indirect air pollutant emissions. c. Impact: The Project will create an increased de- mand for public services. Mitigation Measures: The Project will be designed and constructed to meet requirements of governmental agencies. d. Impact: The Project will create an increased de- mand for public utilities. Mitigation Measures: The Project will be designed for a high degree of efficiency in the use of electricity, gas and water. -2- e. Impact: The increased number of motor vehicles will add pollutants to storm water runoff. Mitigation Measures: Parking area maintenance and street sweeping will be conducted on a regular schedule to collect pollutants before they enter the drainage system. f. Impact: The Project will create employment opportuni- ties thereby stimulating demand for affordable housing in the area. Mitigation Measures: The City is preparing a Housing Element for the General Plan which will address the issue and discuss goals and implementation measures for the provision of affordable housing. g. Impact: The Project will generate 120,000 gallons per day of waste water in excess of the amount projected in the Orange County Sanitation Districts' Master Plan. Mitigation Measures: No mitigation measures are pro- posed. Waste water treatment is the responsibility of the County Sanitation Districts of Orange County. h. Impact: Traffic analysis has indicated that the intersection of Harbor Boulevard and Katella Avenue, due to this development, will operate beyond capacity. Mitigation Measures: The City of Anaheim is currently processing final documentation for federal funding of traffic capa- city improvements at the intersection of Harbor Boulevard and Katella Avenue. The Project will provide for additional lanes at approach onto the intersection therefore increasing traffic capacity. i. Impact: Traffic signal upgrading at intersections impacted by traffic volumes generated by this Project. Mitigation Measures: The Developer is obligated to pay a "traffic signal assessment" based on traffic impacts generated by this development. These funds are to be used for upgrading or adding to the existing traffic signal system. j. Impact: Access to and from the proposed development on Harbor Boulevard and on Convention Way. Mitigation Measures: All ingress and egress geomet- rics will conform to the standard practices and regulations of the City of Anaheim. The adequacy of access, vehicle storage areas and safety of turn movements will be designed for the approval of the City Traffic Engineer. -3- k. Impact: The proposed development will generate substantially increased volumes to significantly impact the ex- isting traffic control system. Mitigation Measures: Measures that are to be employed include turn lane storage facilities, signing median is- land construction and channelization. The Traffic Engineer has determined that no new traffic signal installations are required. 1. Impact: The proposed development site will con- tain a bus travelport. Bus traffic entering or leaving this facility will impact the traffic capacity on Harbor Boulevard and on Katella Avenue. Mitigation Measures: Bus traffic will be confined to right turns in and right turns out only. This will mitigate undue vehicular conflict on the arterial street system by the use of raised median islands. The bus travelport will be limited for the exclusive use of buses only thus mitigating undesirable traf- fic mix. m. Impact: Truck traffic for loading and unloading of supplies, trash collection and exhibit display items will im- pact traffic mix on and off site. Mitigation Measures: In order to mitigate the potential of on -site traffic conflicts due to truck traffic, a separate access with dock facilities will be designed to the safety and geometric requirements of the City Traffic Engineer. n. Impact: The Project will cause an increased demand for on -site parking operations management and directional signing for handling both hotel and Convention attendees. Mitigation Measures: As a part of final design of the Project, a strong program of guide signing within the struc- ture, to guide traffic to parking areas, to exits, and to ramps between levels will be implemented. Signing shall include signing to exits at the end of each parking aisle and at cross- aisles in the structure. Signing guiding pedestrians to the hotel access walk(s) shall be included. o. Impact: During the construction of the Project, the Convention Center's east parking lot will be significantly impacted and reduced in size temporarily. Mitigation Measures: Suitable replacement parking and /or shuttle service, where necessary, may need to be utilized before substantial mitigation of this impact can be assured. -4- 3. That the City Council does hereby further find that changes or alterations have been required in, or incorporated into, the Project which mitigate or avoid, in whole or part, the significant environmental effects specified in subparagraphs a, b, c, d, e, f, g, h, i, j, k, 1, m, n and o of Paragraph 2 above. A statement of facts supporting such finding is as set forth under the heading "Mitigation Measures" for each of said environmental effects as hereinabove respectively set forth. 4. That the City Council of the City of Anaheim does hereby further find that specific economic, social or other considera- tions as set forth in Paragraph 5 below make infeasible other further mitigation measures or Project alternatives identified in the Final EIR for the following significant environmental effects: a. Increased traffic congestion on nearby streets and highways. b. Increased noise and air pollution resulting from the increased traffic. c. Increased requirements for water, electricity, sew- age and solid waste disposal facilities. d. Increased requirements for affordable housing and public services for employees of the facilities. e. Temporary disruption to the surrounding area caused by construction activity during an approximate two -year period. 5. That the City Council of the City of Anaheim has balanced the benefits of the proposed Project against its unavoidable en- vironmental risks in determining whether to approve said Project. The City Council of the City of Anaheim does hereby further find, determine and state, pursuant to the provisions of Section 15089 of the State Guidelines, that the occurrence of those certain sig- nificant environmental effects identified in the Final EIR and set forth in Paragraphs 3 and 4 above will be permitted without further mitigation due to the following overriding considerations: a. The Project will result in the following substantial economic and social benefits to the City of Anaheim and surround- ing area: (1) The City's net revenue for the new 1,000 rooms is estimated at $2,782,900 annually. (2) The Project will create additional employment for 570 people and additional tourist trade of approximately $10,000,000 in off -site retail sales revenue for food and beverage, entertainment and retail merchandise. -5- (3) Major City revenues projected to be g enerated by this Project include annual ground lease payments of approxi- mately $1,859,000; annual transient occupancy tax of approximately $1,621,000; and annual sales tax of approximately $229,600 (All dollar value representation for first year of full hotel operation as measured in 1980 dollars.) b. It is not economically feasible to further mitigate or avoid the environmental effects identified above.
