OERNER IllS DISABLED WITHIN THE MEAN- ING OF ~HE PUBLIIC EMPLOYEES I RETIREMENT LAW FOR TH~PERFO~CE OF HIS DUTIES IN THE POSITIoN OF POLICE OFFICER. WHEREAS!, the Ci tlY of Anaheim is a contracting agency of the Public Em~oyees' Retirement System, and WHEREASI, the Pub;L ic Employees I Retirellent Law requires that a contract in,' agency determine whether an employee of such agency in employm t in wh~ch he is classified as a local safety member is disable. for purposes of the Public Ellployees' Retire- ment Law and whet~er such disability is "industrial" within the meaning of such laW; and WHEREAS!t an application for disability retirement of Steven Koerner em~oyed by the City in the position of Police Officer has been filed with the Public Employees' Retirement System; and WHEREAS, the City Council of the City of Anaheim has reviewed the medipal and other evidence relevant to such alleged disability. NOW, TH~~EFORE, BE IT RESOLVED that the City Council of the City of An~~eim finas and determines, and it does hereby find and determin., that Steven Koerner is incapacitated within the meaning of th~ Public 2mployees' Retirement Law for performance of hi. duties in the position of Police Officer, and ...-...,. BE IT FURTHER RESOLVED that the City Council of the City of Anaheim f~nds and 4etermines, and it does hereby find and determine, that s.Ch disability is a result of injury or disease arising o~t of and in the course of employment; and neither said Stev.n Koerner, nor the City of Anaheim, has applied to the Workers' C~mpensation Appeals Board for a determination pursuant to Section 21026 whether such disability is industrial.
