RESQLUTION NO. 80R-21
A RESOLUTION IF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AP ~OVING A SETTLEMENT AGREEMENT
AND RELEASE W!H SAM D, BATTISTONE, CARLA NAN
BATTISTONE AN : SUN FOOTBALL. INC. IN CONNECTION
WITH SAN BERN~DINO COWNTY SUPERIOR COURT ACTION
NO. 178254.
WHEREAS, disp~tes have arisen between or among the City
of Anaheim and Sun Foottall, Inc., Sam D. Battistone, and Carla
Nan Battistone with regtd to a variety of matters arising primarily
from an Exhibition Agre ~ent dated August 11, 1975, between the
City of Anaheim and Sunltootball, Inc., a promissory note and a
written guarantee of said note by Sam D. Battistone and Carla Nan
Battistone; and
WHEREAS, the ~isputes between the parties resulted in the
filing of an action by the City against Sun Football, Inc., Sam D.
Battistone and Carla Nat Battistone; and
WHEREAS, the ~efendants responded to the complaint by
denying the material al~egations and also cross-complained; and
WHEREAS, eachiof the parties denies the validity of any
and all claims asserted against it by the other party arising out
of the above-described disputes; and
WHEREAS, the parties desire to settle said disputes; and
WHEREAS, an a~~eement entitled "Settlement Agreement and
(hereinafter "Ehe Agreement") has been prepared, the terms
are acceptable to the City Council of the City of Anaheim.

NOW, THEREFO~, BE IT RESOLVED by the ;City Council of the
City of Anaheim that th~ terms and conditions of said agreement are
hereby approved and acc~pted.
BE IT FURTHE~ RESOLVED that the Mayor and City Clerk be,
and they are hereby au~orized and directed to execute said agreement
on behalf of the City af Anaheim.
