80R-196 RESOLUTION NO. 80R-196 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING, IN PART, VARIANCE NO. 3122. WHEREAS, after a request for variance by ANGELO AND IRENE MANNI, owners; GEORGE M. AND LINDA L. SADAGHIANI, agents, was received, a public hearing before the Planning Commission of the City of Anaheim was held upon due and proper notice, a result of which Variance No. 3122 was granted, in part, covering the following described property: Lots 12 and 13 of Tract 1098, in the City of Anaheim, as per map recorded in book 39, pages 1 and 2 of Miscellaneous Maps, in the office of the County Recorder of said County; and WHEREAS, thereafter, within the time prescribed by law, an interested party or the City Council, on its own motion, caused the review of said Planning Commission action at a public hearing noticed and held as prescribed by law and, as a result thereof, the City Council does hereby make the following findings: 1. That there are special circumstances applicable to the property, including size, shape, topography, location or surround- ings, which do not apply to other property under identical zoning classification in the vicinity. 2. That, because of special circumstances shown in (1) above, strict application of the zoning code deprives the property of privileges enjoyed by other property under identical zoning classi- fication in the vicinity. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby, '}ranted permitting two (2) duplexes (four (4) apartments on two (2) parcels) on the property hereinbefore de- scribed with waivers of the following sections of the Anaheim Municipal Code: SECTION 19.26.020.010 Permitted primary uses and structures. (2 single- family dwellings permitted; 4 dwelling units existing) SECTION 18.26.061.011 Minimum lot area per dwelling unit. (7200 square feet required; 3712 square feet existing) SECTION 18.26.062.030 Minimum floor area per dwell ing unit. (1225 square feet required; 826, 1151 and 1181 square feet proposed) -1- That said variance be granted in part subject to the following conditions: 1. That the existing structures shall be brought up to the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City Anaheim. 2. Plans shall be submitted to the Building Division show- ing compliance with the minimum standards of the City of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical and Fire Codes as adopted by the City of Anaheim. The appropriate permits shall be obtained for any necessary work. 3. That, except as hereinafter provided, subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. 1 through 5. 4. That the fence separating the two subject parcels shall be removed to provide additional shared parking spaces and the area shall be appropriately landscaped and maintained. 5. That the paving in the front yard area of the easterly parcel shall be removed and replaced with landscaping. 6. That the converted garage on the easterly parcel be re- converted to garage use with no open parking spaces within the 25-foot setback area. 7. That Condition Nos. 1, 2, 3, 4, 5 and 6, above-mentioned, shall be complied with within 120 days following the date of adop- tion of this resolution. BE IT FURTHER RESOLVED that the City Council hereby re- serves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns to com- ply with the Anaheim Municipal Code and regulations and the condi- tions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein.
