A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DECLARING THE CITY OF ANAHEIM TO
BE SUBJECT TO THE PROVISIONS OF THE PUBLIC
RESOURCES CODE OF THE STATE OF CALIFORNIA
PERTAINING TO GEOLOGIC HAZARD ABATEMENT
DISTRICTS
WHEREAS, Division 17 of the Public Resources Code of
the State of California (commencing at Section 26500)
contemplates and permits the creation of geologic hazard
abatement districts to, among other things, prevent, mitigate,
abate and control geologic hazards; and,
WHEREAS, Section 26550 of the Public Resources Code
does provide that the provisions of Chapter 2 of Division 17 of
the Public Resources Code pertaining to geologic hazard abate-
... ment districts shall be inoperative as to a legislative body
unless and until the legislative body has, by resolution,
declared itself to be subject to the provisions of Chapter 2 of
Division 17 of the Public Resources Code and has forwarded a copy
of such resolution to the State Controller; and,
WHEREAS, the City of Anaheim, either singularly or in
conjunction with other local agencies, may wish to cause the
creation of one or more geologic hazard abatement district(s),
either entirely within the boundaries or the City of Anaheim or
including properties located in other local agencies.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Anaheim does hereby declare that the City of Anaheim
is subject the provisions of Chapter 2 of Division 17 of the
Public Resources Code of the State of California.
BE IT FURTHER RESOLVED that the City Clerk be, and she
is hereby, authorized and directed to forward a certified copy of
this resolution to the Office of the State Controller.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 5th day of January,
1999.
