RESOLUTION NO. 80R-262
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM DETERMINING THAT CERTAIN PUBLIC
STREET (S) SHOULD BE ABANDONED AND ESTABLISH-
ING CONDITIONS PRECEDENT TO SAID ABANDONMENT.
(TUSTIN AVENUE)
WHEREAS, the City Council of the City of Anaheim has
elected to proceed under the provisions of the Street Vacation
Act of 1941 (Section 8300 et seq., Streets and Highway Code)
in connection with requests for vacation and abandonment of
public streets within the City of Anaheim; and
WHEREAS, the City Council did, by resolution duly
posted and published, give notice of its intention to abandon
the following described public street; to wit, portion of
Tustin Avenue (hereinafter "Street") more specifically des-
cribed as follows:
That certain road and public utility easement
together with slope easements reserved and des-
cribed in the deed recorded April 15, 1980 in
Book 13574, pages 602, 603 and 604, records
of Orange County, California, described as:
That portion of the land described as Parcel Two
in the Document recorded August 29, 1968 in Book
8706, pages 1 and 2, records of said Orange County,
described as:
Beginning at the most northerly corner of Parcel
2, Relinquishment of Highway Right of Way in the
City of Anaheim, Road 07-0RA-9l-8.4 Request
Number 605, as shown on a Document recorded
August 29, 1968 in Book 8706, page 9, Official
Records, records of said Orange County; thence
Southerly along the easterly line of said
Parcel 2, S 100 01' 11" E, 95.26 feet; thence
S 820 25' 43" W, 4.09 feet; thence S 20 13'
08" W, 19.86 feet to the southeast corner of
said Parcel 2; thence Southwesterly along the
southerly line of said Parcel 2, S 760 14' 42"
W, 30.93 feet to a point on a non-tangent
curve concave easterly with the radial bearing
from said point being N 690 23' 04" E, having
a radius of 1147.00 feet; thence Northerly along
said curve an arc distance of 112.61 feet through
a central angle of 50 37' 30" to a point on the
northerly line of said Parcel 2; thence Easterly
along said northerly line N 740 44' 37" E, 54.63
feet to the point of beginning.

WHEREAS, on the 10th day of June, 1980 a public hearing
was held to allow interested persons to submit evidence con-
cerning said proposed abandonment; and
WHEREAS, the City Council of the City of Anaheim does
find from the evidence submitted to it that said Street is
unnecessary for present or prospective public use; and
WhEREAS, the City Council has further determined that
certain conditions must be met prior to making of an order
vacating and abandoning said Street.
NOW, THEREFORE, BE IT RESOLVED that the City Council
of the City of Anaheim does determine that said Street should
be abandoned and vacated subject to the following conditions:
Purchaser to enter a slope maintenance agree-
ment satisfactory to the City Attorney's Office.
BE IT FURTHER RESOLVED that should the conditions set
forth in the preceding paragraph be fulfilled within one hundred
eighty (180) days of the date of this Resolution, the City Council
will make its order vacating and abandoning said Street.
BE IT FURTHER RESOLVED that should all of said conditions
not be fulfilled within said one hundred eighty (180) days of such
further time as the City Council may grant, then this Resolution
shall terminate, and resort shall be had to a new and separate
proceeding.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of June, 1980.
