80R-268 RESOLUTION NO. 80R-268 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THAT A CERTAIN PUBLIC ALLEY SHOULD BE ABANDONED AND ESTABLISHING CONDITIONS PRECEDENT TO SAID ABANDONMENT. WHEREAS, the City Council of the City of Anaheim has elected to proceed under the provisions of the Street Vacation Act of 1941 (Section 8300 et seq., Streets and Highways Code) in connection with requests for vacation and abandonment of public streets within the City of Anaheim; and WHEREAS, the City Council did, by resolution duly posted and published, give notice of its intention to abandon the follow- ing described public alley; (hereinafter "Street") more specifi- cally described as follows: That certain 10.00-foot easement for alley purposes, in the City of Anaheim, County of Orange, State of California, as shown in Block D, Zeyn Tract Annex, as per map recorded in Book 7, page 5, Miscella- neous Maps, records of said Orange County. Reserving therefrom unto the City of Anaheim, an easement for sanitary sewer purposes over, under and across said alley. Also reserving therefrom unto the City of Anaheim an easement for ingress and egress for sanitary maintenance sewer purposes, including roadway improvements for vehicular ingress and egress not less than 10 feet in width over, under, along and across said alley. Also reserving therefrom unto the City of Anaheim, a public utility easement for the installation and maintenance of underground and overhead electric wires, cables and related electrical facilities over, under, and across said alley. Together with all reasonable rights of ingress and egress. Also reserving therefrom unto the Pacific Telephone and Telegraph Company a public utility easement to construct, place, operate, inspect, maintain, repair, replace and remove such aerial and underground tele- phone, telegraph and communication structures, as the Company may from time to time require, consisting of poles, anchors, wires, cables, conduits, manholes, markers and necessary fixtures and appurtenances over said alley together with all reasonable rights of ingress and egress. Said reservation to said Telephone and Telegraph Company is subject to the prior rights of the City of Anaheim under the above-stated re- servations. 79-16A WHEREAS, on the 17th day of June, 1980, a public hearing was held to allow interested persons to submit evidence concerning said proposed abandonment; and WHEREAS, the City Council of the City of Anaheim does find from the evidence submitted to it that said Street is un- necessary for present or prospective public use; and WHEREAS, the City Council has further determined that certain conditions must be met prior to making of an order vacating and abandoning said Street. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does determine that said Street should be abandoned and vacated subject to the following conditions: That gates, acceptable to the City Engineer shall be installed where said alley enters Sycamore Street and Alberta Street. BE IT FURTHER RESOLVED that should the conditions set forth in the preceding paragraph be fulfilled within one hundred eighty (180) days of the date of this Resolution, the City Council will make its order vacating and abandoning said Street. BE IT FURTHER RESOLVED that should all of said conditions not be fulfilled within said one hundred eighty (180) days or such further time as the City Council may grant, then this Resolution shall terminate, and resort shall be had to a new and separate proceeding.
