RESOLUTION NO. 86R-458
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM TERMINATING A CONTRACT WITH C & J
CONSTRUCTION, INC.
WHEREAS, the City Council did on March 18, 1986, adopt a
resolution awarding a contract for construction of pedestrian
access ramps to C & J Construction, Inc. ("CONTRACTOR"); and
WHEREAS, CONTRACTOR commenced work on said project; and
WHEREAS, CONTRACTOR has abandoned the project and failed
to re-commence the work after notice to do so; and
WHEREAS, the prompt completion of project is necessary to
the health, safety and welfare of the citizens of the City of
Anaheim; and
WHEREAS, this project is for the installation of
pedestrian access ramps.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that:
1. C & J Construction, Inc. is hereby declared in default of
its performance of the contract.
2. The contract with C & J Construction, Inc. is hereby
terminated pursuant to Sections 18 and 21 of said contract.
3. The City Engineer be, and he is hereby, authorized to
complete or cause to be completed the work remaining on the
project for the account and at the expense of C & J Construction,
Inc., and the City Engineer may take possession of and utilize
such materials, appliance and plant as may be on the site of the
work and necessary therefor.
BE IT FURTHER RESOLVED that the City Attorney is
authorized and directed to institute such actions, including legal
proceedings to recover any damages sustained by the City of
Anaheim as a result of the abandonment of the work by C & J
Construction, Inc. against C & J Construction, Inc., its bonding
companies, and any other responsible parties.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim t .s 14th day of October, 1986.
