69R-555 RESOLUTION NOe 69R-5" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NOo 1129 WHEREAS, th~ City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from LEO FREEDMAN, 10350 Almayo, Los Angeles, California, Owner; NORMAN HAaN, P.O. Box 6049, Anaheim, California, Agent, to establish a church use in an existing theater structure and to establish a structure having a height in excess of 75-feet, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: The West 20 acres of the following described land: Beginning at a point on the East line of Section 22, Township 4 South, Range 10 West, San Bernardino Base and Meridian, in the City of Anaheim, designated by a stake marked "A", 675 feet North of the Southeast corner of sa~d Section 22; thence North 645 feet along the East line of said Section 22; to a point designated by a stake marked "B" at the junction of the East line of said Section 22, with the South line of land formerly owned by H. D. Polhemus; thence West 2640 feet parallel with the South line of said Section 22, and at a uniform distance therefrom of 1320 feet to a point designated by a stake marked "C"; thence South 645 feet parallel with the East line of said Section 22 and at a uniform"distance therefrom of 2640 feet to a point designated by a stake marked "D", 675 feet distant from and North of the Southwest corner of the Southeast quarter of Section 22; thence East 2640 feet parallel with the South line of said Section 22 and at a uniform distance therefrom of 675 feet to the point of begipning. EXCEPTING THEREFROM the West 720 feet thereof; ALSO EXCEPTING THEREFROM the North 60 feet. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on August 11, 1969 >> n.otices .of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Mmnicipal Code; and continued public hearing on August 25, 1969; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. PC 69-175 ______ granting,.... Conditional Use Permit No. ,,?q subject to certain conditions therein ~p.t fnrr~and WHF.RFA~ rh~~~~Tr~r w;rh;n rw~nrv_r~n {,?, nbV~ Trnm October 7 , 19 69 ,at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the titne and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an oppor- tunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hear- ing, that Conditional Use Permit No. 1129 should be denied. NOW, THEREFOU9 BE IT RESOLVED by the Cit:y Council of the City of Anahetm that the action of the City Planning Com- mission qranting Conditional Use Permit No. 1129 be, and the same is hereb, disapproved ,and that the request of Leo Freedman, Owner, and Norman Hahn, Agent, to establish a church use in an existing theater structure and to establish a structure having a height in excess of 75-feet with waivers of (1) maximum size height, (2) minimum height of sign base, (3) sign location, (4) maximum sign area, and (5) minimum required number of parking spaces, be, and the same is hereby denied. this THE FOREGOING RESOLUnON 7th day of October 1s approved and aigned by me , 19 69 .
