RESOLUTION NO. 69R-S40
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING AN EASEMENT GRANT DEED
CONVEYING TO THE CITY OF ANAIIEH1 CERTAIN REAL
PROPERTY FOR AN EASEMENT FOR ROAD AND PUBLIC
UTILITY PURPOSES.
WHEREAS, the City Council of the City of Anaheim is
desirous of purchasing the hereinafter described real property
for municipal purposes, to wit: An easement for
road and public utility purposes
and
WHEREAS, the owner of said property ha s offered
to sell and convey the same to the City; and ----
WHEREAS, the City Council of the City of Anaheim finds
that it is for the benefit and best interest of the City of
Anaheim to accept said offer and purchase said real property.
Nm'i', THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of
BANK OF AMERICA NATIONAL TRUST AND SAVINGS ASSOCIATION,
a national banking association
to sell to the City of Anaheim the following described real
property situated in the City of Anaheim, County of Orange,
State of California, to be used for an easement for
road and public utility purposes
, and more particularly described as follows:
An easement for road and public utility purposes over,
under and across that portion of Lot 5, Block C of
Davis Brothers Addition to Anaheim, as per Map recorded
in Book 2, pages 632 and 633 of Miscellaneous Records
of Los Angeles County, California described as follows:
Beginning at the intersection of the centerline of Elm
Street, formerly known as Davis Street, 50 feet in width
with the centerline of Helena Street, 50 feet in width;
thence South 740 30' West along the centerline of said
Elm Street a distance of 39.92 feet; thence North 150
30' West a distance of 25 feet to the beginning of a
curve concave Northwesterly and having a radius of 15
feet, a radial line bearing South 150 30' East passes
through the point of beginning of said curve; thence
Easterly and Northerly along said curve through a central
angle of 890 53' an arc distance of 23.53 feet to an
intersection with a line parallel with and 25 feet
Westerly of the said centerline of said Helena Street;
thence North 740 37' East a distance of 25 feet to an
intersection with the said centerline of said Helena
be, and the same is hereby, accepted by the City Council of the
City of Anaheim, and that the City of Anaheim accept a convey-
ance of said property.
BE IT FURTHER RESOLVED that the Director of Finance of
the City of Anaheim be, and he is hereby, authorized to pay to the
owner or owners of said real property, out of General Funds of
the City of Anaheim, the sum of One Dollar ($l.OO).
