69R-516 RI:.:SOLUTICL' 'W. 69R-51&..._.._ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- ings No. 69-70-7 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Planning Commission the City Council did fix the 10th day of Septe$er , 19 €if as the time, and the City Council Chambers ln the City Ha 1 of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County Portion IIAt:. That portion of the northeast quarter of the northeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in the Office of the County Recorder of Orange County, California, described as follows: Beginning at a point in the southerly line of Parcel No. 1 of the land described in a deed to the State of California recorded June 19, 1956 in Book 3548, page 539 of Official Records and distant thereon North 890 40' 53" East 60.00 feet from the southwesterly corner of said Parcel No.1, thence North 890 49' 53" East 272.76 feet along said southerly line and its easterly prolongation thereof to the northwesterly corner of Tract No. 4230 as shown on a map recorded in Book 243, pages 43 and 44 of ~tiscellaneous Maps, records of said Orange County; thence South 00 16' 08" East 200.00 feet along the West line of said Tract No. 4230; thence South 890 40' 53" West 332.65 feet to a point in the West line of the northeast quarter of the northeast quarter of said Section 14; thence North 00 18' 0511 West 180.00 feet along last mentioned West line to a point in the south- erly line of Parcel No. 2 of the land described in the afore- said deed to the State of California; thence along the southerly and southeasterly boundarJ lines of said Parcel No.2; North 890 40' 53" East 40.00 feet and North 440 41' 24" East 28.29 feet to the point of beginning. That portion of the northeast quarter of the northeast quarter of Section 14, Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Ancl1eim, County of Orange, State of California, as shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in tl1e Office of the County Recorder of Orange County, California, described as follows: Beginning at a point in the West line of e1e northeast quarter of tile northeast quarter of said Section 14, distant thereon South 00 18' 05" East 180.00 feet from the southwesterly corner of Parcel No. 2 of the land described in a deed to the State of California recorded June 19, 1956 in Book 3548 page 539 of Official Records, thence South 00 18' 05" East 185.40 feet continuing along said West line; thence North 890 40' 53" East 193.00 feet parallel with the North line of the northeast quarter of the nortl1east quarter of said Section 14; thence North 00 18' 05" West 185.40 feet parallel with the West line of the northeast quarter of the northeast quarter of said Section 14; thence South 890 40' 53" West 193.00 feet to the point of beginning be excluded from R-A, RESIDENTIAL-AGRICUL'I'URAL ZONE and R-3, ~IDLTI-FAMILY RESIDENTIAL ZONE, and incorporated in C-l, GENERAL COHMERCIAL ZONE, as to Portion "A", and that Portion HB h be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, to R-3, MULTIPLE-F~1ILY RESIDENTIAL ZONE, subject to the following condi- tions: 2. That all engineering requirements of the City of Anaheim along Lincoln and Grand Avenues, including preparation of improvement plans and installation of all inprovements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of tl1e City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Grand Avenue and all but the easterly 140 feet of the Lincoln Avenue frontage for street lighting purposes. 4. That the owners of subject property shall pay to the City of Anaheim the sum of 159 per front foot along Grand Avenue and all but the easterly 140 feet of the Lincoln Avenue frontage for tree planting purposes. 5. That a Parcel Map to record the approved division of subject property be submitted to the City of An~leim for approval and then be recorded in tl1e Office of the Orange County recorder. 6. That trash storage areas shall be provided in accordance with approved plans on file with the Office of the Director of Public Works. 7. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 8. That a 6-foot masonry wall shall be constructed along the south and east property lines of Portion At said wall to be required along the easterly property line only where Portion A abuts the R-3 property to the east. 9. That any air-conditioning facilities proposed shall be properly shielded from view and the sound shall be buffered from adjacent residential homes. 10. That any parking area lighting shall be lighted with down-lighting a maximum 6-feet in height and shall be directed away from the property lines to protect the residential integrity of the area, on Portion A only. 11. That subject development shall be served by underground utilities. 12. That Condition Nos. 1, 2, 3 and 4, above mentioned, shall be complied with witl1in a period of 180 days from the date hereof, or such further time as the City Council may grant. 13. That Condition Nos. 5, 6, 7, 8, 9, 10 and 11, above mentioned, shall be complied with prior to final building and zoning inspections. Council Resolution of $75.00 per dwelling unit, which shall be used for park and recreation purposes[ said amount to be paid at the time the Building Permit is issued. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
