69R-498 RESOLUTION NO. 69R- 498 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO VACATE AND ABANDON AN EXISTING ROADWAY COMMONLY KNOWN AS ALMONT STREET AND EASEMENTS FOR ROADWAY, SEWER, PUBLIC UTILITY AND DRAINAGE PURPOSES UPON, OVER, ACROSS, UNDER, ALONG AND THROUGH THE HEREINAFTER DESCRIBED REAL PROPERTY: FIX- ING A TIME AND PLACE FOR HEARING THEREON: DIRECTING THE POSTING OF NOTICES THEREOF AND THE PUBLICATION OF THIS RESOLUTION. WHEREAS, a request has been made for the abandonment of an existing roadway commonly known as Almont Street and easements for roadway, sewer, public utility and drainage purposes upon, over, across, under, along and through the hereinafter described property; and WHEREAS, the City Council of the City of Anaheim does elect to proceed under the provisions of the Street Vacation Act of 1941, to abandon or vacate said existing roadway commonly known as Almont Street and easement for roadway purposes and under the provisions of the Public Service Easement Vacation Law, Title 5, Division 1, Article 5 of the Government Code, to abandon said easements for sewer, public utility and drainage purposes. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare that it intends to vacate, abandon and close to public use an existing roadway common- ly known as Almont Street and easements for roadway, sewer, public utility and drainage purposes upon, over, across, under, along and through the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Those certain easements located in the City of Anaheim, County of Orange, State of California, conveyed to the City of Anaheim by deeds recorded in Book 8879, pages 143, 145 and 146, on February 19, 1969, in Official Records of Orange County, California, to be abandoned, described as follows: Parcel One: An easement for road and public utility purposes over, under and across that portion of Lot 1 of Tract No. 6646, as shown on a Map thereof recorded in Book 249, pages 38 and 39 of Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the Southeast corner of said Tract 6646; thence South 890 56' 2811 West a distance of 23 feet; thence North 00 05' 09" East a distance of 96.15 feet to the beginning of a tangent curve concave Southwesterly and having a radius of 25 feet; thence Northerly and Westerly along said curve through a central angle of 840 16' 40" an arc distance of 36.77 feet to the beginning of a curve concave Southerly and having a radius of 368 feet, a radial line bearing North 50 48' 29" East passes .&..1-__...._1- .&..1-_ __.: _.&.. _.I: t....__": __.: __ _.t: __':..:J _..._.._.. .....1.-..__,.._ t\T,........~h...,.,,~~_ 25 feet; thence Northerly and Northwesterly along said curve through a central angle of 900 00' 0011 an arc distance of 39.27 feet; thence South 890 56' 2811 West a distance of 131.16 feet to the beginning of a tangent curve concave Southeasterly and having a radius of 50 feet; thence Westerly and Southwesterly along said curve through a central angle of 500 12' 2911 an arc distance of 43.81 feet to the beginning of a reverse curve concave Northeasterly and having a radius of 50 feet; thence Southwesterly, Westerly, Northwesterly, Northerly and North- easterly along said curve through a central angle of 2010 51' 02" an arc distance of 176.15 feet; thence North 890 56' 2811 East a distance of 283.81 feet to the beginning of a curve concave Southwesterly and having a radius of 64 feet, a radial line bearing North 240 56' 56" East passes through the point of beginning of said curve; thence Southeasterly and Southerly along said curve through a central angle of 640 59' 32" an arc distance of 72.60 feet; thence South 00 03' 32" East a distance of 40.00 feet to the beginning of a tangent curve concave Northeasterly and having a radius of 25 feet; thence Southerly and Southeasterly along said curve through a central angle of 900 00' 0011 an arc distance of 39.27 feet; thence North 890 56' 2811 East a distance of 115.18 feet to the beginning of a tangent curve concave Southerly and having a radius of 432 feet; thence Easterly and Southeasterly along said curve through a central angle of 40 26' 1111 an arc distance of 33.45 feet to the begin- ning of a reverse curve concave Northwesterly and having a radius of 25 feet; thence Northeasterly and Northerly along said curve through a central angle of 940 17' 3011 an arc distance of 41.14 feet; thence North 00 05' 09" East a distance of 99.43 feet; thence North 890 56' 2811 East a distance of 23 feet; thence South 00 05' 09" West a distance of 310.00 feet to the point of beginning. Parcel Two: An easement for sewer, public utility and drainage purposes over, under and across that portion of Lot 1 of Tract No. 6646, as shown on a Map recorded in Book 249, pages 38 and 39 of Miscellaneous Maps, records of said Orange County, des- cribed as follows: Commencing in the Northwest corner of said Tract 6646, thence North 740 36' 54" East a distance of 15.00 feet; thence South 150 23' 0611 East a distance of 22.83 feet to the true point of beginning; thence North 740 36' 54" East a distance of 121.06 feet; thence North 890 56' 28" East a distance of 109.07 feet to the beginning of a curve concave Easterly and having a radius of 50 feet, a radial line bearing North 620 40' 18" West passes through the point of beginning of said curve; thence Southwest- erly and Southerly along said curve through a central angle of 230 56' 51" an arc distance of 20.90 feet; thence South 890 56' 28" West a distance of 100.86 feet; thence South 740 36' 54" West a distance of 118.36 feet; thence North 150 23' 06" West a distance of 20 feet to the true point of beginning. .....-----, ""'------ mk~_~ ~~_~~;~ ~~~a~~ r;Nnr~ rn ~~~TP Colleae BE IT FURTHER RESOLVED that reference is hereby made to a map on file in the Office of the City Clerk for further particu- lars as to the proposed vacation, abandonment and closing to public use of said existing roadway commonly known as A1mont Street and easements for roadway, sewer, public utility and drainage purposes. BE IT FURTHER RESOLVED that a time and place for hearing all persons interested in or objecting to the proposed vacation and abandonment shall be fixed not less than fifteen (15) days from the date of the passage of this Resolution. That the -16.:tb day of ~tember , 1969, at 1:30 o'clock P.M. in the CouncrI-Charnbers 1n e City Hall in the City of Anaheim is hereby fixed as the time and place for a public hearing on the matter of such vacation, abandonment and closing to the public use of said roadway and ease- ments for roadway, sewer, public utility and drainage purposes, for all persons interested in or objecting to such proposed vaca- tion, abandonment and closing to public use to appear and show cause, if any they have, why such roadway and easements and the use thereof for the purposes hereinabove mentioned should not be vacated, abandoned and closed to public use; and BE IT FURTHER RESOLVED that notices of such proposed vacation and abandonment of said roadway and easements and the use thereof for the purposes herein mentioned shall be posted con- spicuously along the line of said roadway and easements at least ten (10) days before the date set for said hearing. Such notices shall be posted not more than 300 feet apart, and at least three (3) such notices shall be posted. Such notices shall state the passage of this Resolution of Intention and the time and place of the hearing upon the matter of such vacation and abandonment of said roadway and easements; and BE IT FURTHER RESOL~D that proof of publication of any notice required by this resolution shall be made by affidavit as provided in the Code of Civil Procedure, and proof of posting of any such notice shall be made by affidavit of the person posting the notice, setting forth the facts regarding such posting; and BE IT FURTHER RESOLVED that the City Clerk. shall certify to the passage of this resolution and shall cause the' same to be published in the manner prescribed by law, in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in said City of Anaheim.
