2005-036RESOLUTION NO. 2005 - 36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE CHIEF OF POLICE TO FILE AN APPLICATION, ON BEHALF OF THE CITY OF ANAHEIM, WITH U.S. DEPARTMENT OF JUSTICE, OFFICE OF JUVENILE AND DELINQUENCY PREVENTION (OJJDP), FOR THE "FY 05 OJJDP CONGRESSIONAL EARMARK" GRANT PROGRAM, AUTHORIZING THE CHIEF TO EXECUTE ALL REQUIRED GRANT DOCUMENTS, AND, IF AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH GRANT ON BEHALF OF THE CITY AND AMENDING THE BUDGET FOR THE FISCAL YEAR IN WHICH THE GRANT FUNDS ARE RECEIVED ACCORDINGLY WHEREAS, the United States Department of Justice, Office of Juvenile Justice and Delinquency Prevention, has heretofore invited public agencies, including the City of Anaheim, to submit applications for the "FY 05 OJJDP Congressional Earmark" Grant Program which makes funds available to law enforcement agencies to assist in delinquency prevention and school safety (the "Grant"); and WHEREAS, the City of Anaheim desires to submit an application for said Grant to fund salary and benefits for one (1) Recreation Supervisor and operating expenses for the Anaheim Police Activities League (APAL) Center in the amount of Two Hundred Forty-Six Thousand Six Hundred Sixty-One Dollars ($246,661.00); and WHEREAS, the City is familiar with the terms, conditions and limitations of any such Grant; and WHEREAS, the City is willing and able to conform to each of the terms, conditions and limitations imposed upon any such Grant to the City; and WHEREAS, the City desires to accept any such Grant which may be awarded to the City; and WHEREAS, the City Council desires to amend the annual budget of the City to reflect and incorporate any Grant so awarded to the City in the appropriate City program. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: 1. The Chief of Police of the City of Anaheim is hereby authorized, on behalf of the City of Anaheim, to submit an application to the United States Department of Justice, Office of Juvenile Justice and Delinquency Prevention, for participation in the, "FY 05 OJJDP Congressional Earmark" Grant Program, and to T _ _, execute on behalf of the City all required Grant documents, including any extensions and amendments thereof. 2. The City Council of the City of Anaheim hereby agrees to, and by this resolution, does accept any such Grant so awarded to the City of Anaheim, including any additional funding added to the original grant contract as a result of a contract amendment, without further action of the City Council being required therefor. 3. The City of Anaheim hereby agrees to comply with each and all of the terms, conditions and limitations imposed by the grantor upon said Grant, and the Chief of Police is hereby authorized and directed to execute any agreements, assurances, or other documents as may be necessary in connection with the acceptance of said Grant as may be required by the grantor, if such Grant is awarded to the City. 4. Contingent upon the award of said Grant and the receipt of Grant funds, the annual budget of the City of Anaheim for the fiscal year in which the Grant funds are received is hereby amended to reflect and incorporate any portion of such Grant award in Program No. 218-309-3005.
