A RESOLUTIOi~ OF ThE CI'l'Y COUlIiCIL OF THE CITY
OF m~}~EIM APPROVING l-V~D AUTHORIZING THE
EXECUTION OF A COOPEEATIVE AGREElV.JENTWITH
ORANQ.; COUNTY FLOOD CONTHOL DISTRICT vHTH
P~FERENCE TO CONSTRUCTION OF A PORTION OF
THE SPIMJAKER STORiVl DRAIN.
WHEREAS, funding for construction of the Spinnaker
Storm Drain, a large undergrouna storm drain beginning at the
tast Garden Grove - Wintersburg Channel terminus at Chapman
,tl.venue and running northerly to Katella Avenue, was included
in the Flood Control District's unsuccessful 1967 bond issue
~roposal to remedy flooding problems along several streets of
the City of Anaheim's residential ana commercial areas; and
WhEREAS, Orange Count:'l Flood Control District now pro-
poses, with its limited pay,.as-you-go funds, to construct a
portion of the Spinnaker Storm Drain running from the East
Garden Grove -\~intersburg Channel terminus to the northerly side
of Pacifico Avenue at its intersection with Lewis Street; and
,.mEHEAS, the City of Anaheim, in order to secure early
Denefits from sa~a portion of tne Spinnaker Storm Drain to be
constructed by Orange County Flood Control District, desires
said District to include in its contract for construction of
said portion of storm drain, an extension of the storm drain to
the intersection of Lewis Street and Katella Avenue; and
IlHEREAS, the City of Ananeim and Orange County Flood
Control District have agreed that it is in the best interest of
said District and the City to cooperate financially in the
construction of said portions of said storm drain as a joint
venture under a sin~;le contract, and
WHEREAS, Orange County Flood Control District has
submitted to the City a form of agreement, designated !lAgreement
1'Jo. C345," to be made and entered into by and between the parties
providing for the joint construction of said storm drain~ upon
tile terms and conditions, and for the proportionate share of the
costs therein set forth, and for the maintenance thereof; which
agreement the City Council finds is satisfactory and should be
approved.
NOW, TULREFORE, BE I~ RESOLVED by the City Council of
tile City of Anaheim that the agreement, designated "Agreement
No. C345, submittea to the City by Orange County Flood Control
District to be made and entered into by and between the parties,
foroviding for the joint construction of those portions of the
Spinnaker Storm Drain hereinbefore described, upon the terms and
condi tions and for tile proportionate share of the costs set
forth in said agreement, and for the maintenance thereof, be,
and the same is hereby approved.
BE IT FURTHER FlliSOLVED that the i-layor and City Clerk be,
and they are hereby authorized to execute said agreement for and
on behalf of the City of Anaheim.

BE IT FURTHER RESOLVED that the Director of Finance
be, and he is hereby authorized to pay to Orange County Flood
Control District the Citys share of the costs of said
construction, estimated to be approximately $120,000, plus
10% of City's total costs to cover said District's cost of
aesign, inspection, field engineering, etc., as more particularly
set forth in said agreement.
THE FOlillGOING RESOLUTION is approved and signed by
