1968-630 RESOLUTION NO 68R-630 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 2012 WHEREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from Eu~eni~ Weston Dorian. et al., owners of certa1n real property situated 1n the City of Anaheim, County of Orange, State of California, described as follows: Lots 4 and 5 of Tract No. 2637, as shown on a map recorded in Book SO, Pages 1 and 2 of Miscellaneous Maps, Records of Orange County, California. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on Se-ptember 11, 1968 , notice of which said public hearing was duly given as required by law and the provisions of T.i.tle 18, Chapter 18.76 of the Anaheim Municipal Code i and WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC68-275 recommending that Variance No. 2012: in part, subject to the conditions therein set forth ; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the city Planning Commission in qrantinq said variance and did set a public hearing thereon to be held on the 22nd day of _October , 19 68 , at 1:30 o'clock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as required by law and the provisions of Title 18, Chapter lS,76 of the Anaheim Municipal Code; and -1- i.::lEPE1\S, after due lr:vcst:..qatlon and stUGleS made by ':sclf and ill Its Lc:haU ,~1l1C' after (~ue conslC1eratlon of all the v]dence and reports offered at saId hearing, the City CouncIl .oes fIne: an(! detOlI,ll nc thcl.t; 1. rhere are exceptIonal or extraorClnary Clrcum- stances or condItlcns applicable to the property Involved or to the lntended use of the property that do not apply generally to the property or class of use In the same VICinlty and zone. )." . -lhat SUCh a variance is necessary for the preser- vatIon and enjoyment of a substantial property rIght possessed by other property in the same ViCInIty 0nd 20ne and denIed to the property In quest:ion 3. That this variance is granted subject to the completion of Reclassification Proceedings No. 68-69-24 now pending. 2. 'l'ilat trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building and zoning inspection. 3. That all air-conditioning facilities shall be properly shielded from view, and the sound buffered from adjacent residential homes, prior to final building and zoning inspections. ~. That prior to the sale or separate financing of any unit, a Parcel ,-,lap shall be submitted to the City for Anaheim for approval, and then recordea in the Office of ~1e Orange County Recorder. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim ,iuniciDal Code and regulations and the conditions herein. Said variance is granted for the terlli prescribed by the Anaheim Muni- cipal Code unless otherwise specifiea herein. - 2" BE IT FUH:fhEl{ RESOLVED that that portion of the petition for a zoning variance requesting a waiver of the maximum height limitation of any building located within 150 feet of a single- family residential zone be, and the same is hereby denied.
