1968-629 RESOLUTION I-JO. _J5_~g::.62_L 1\ HESOLU'l'l ON OF T'BE CITY COUNCIL OF' 'l'HE CI'I'Y OF' ANAIIEH1 FINDING AND DETERMINING THAT TITLE 18 OF 'THE ANlillEIM I.1UNICIPAL CODE RELA'rING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceed- lngs No. 68-69-24 to consider an amendment to Title 18 of -the Anaheim MuriTCTpal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did rece~ve evidence and reports from persons interested therein and from its staff; and WHEEEAS, wIthin a period of forty days following said nearing the Planning Commission did duly adopt a resolution containing a report of its findings, a sU~TIary of the evidence presented at said hearing, and a recommendation that the pro- posed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and ~vHEREAS I upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City ~'lanning Commission the City Council did fix the 22nd day of October , 19 68 as the time, and the City Council Chambers in the Ci t:y' rIall of the City of Anaheim as the place for a public hearing upon sai.d proposed amendment to Title 18 of the Anaheim r.lunicipal Code, and the exclusion of said property, hereInafter described, from the zone or zones in which it is now situated and the incorporation thereof in the zone or zones hereinafter set forth, and did give notice there- of in the manner and form as proviaed in said Title 18 of the Anahel.m ~lnicipal Code; and \,.mEREAS t at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of fIndings and recornmendatlon; and WHEREAS, the City Council does find and determine tnat the amendment to '1'i tIe 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described snould be excluded from the zone or zones in which it is now situated dnd incorporated in the zone or zones as hereinafter ,3et forth. NOW, THEREFORE, BE IT lillSOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim I".!unicipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of CalifornIa, to wit: -1- 68-69-24 Lots 4 ana 5 of Tract No. 2637, as shown on a map recorded in Book 80, Pages 1 and 2 of ~tiscellaneous Maps, Records of Orange County, California. be excluded from C-l, GENERAL COtw~RCIAL ZONE, and incorporated in R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall pay to the City of Anaheim the sum of 15~ per front foot, along Winston Road and Iris Street for tree planting purposes. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recrea- tion purposes, said amount to be paid prior to the issuance of a building permit; PROVIDED, HOWEVER, that in the event said sum shall not have been paid by May 1, 1969, there shall be due and payable prior to the issuance of a building permit the sum of $150.00 per apartment unit. 3. That Condition No.1, above-mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE I'l' FURTHLR RESOLVED that tne City Attorney be, and he is nereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplisn the objects herein found and deter- nuned to be necessary and proper.
