1968-610 RESOLUTION NO, 68R-6l0 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CER- TAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Ana- heim has heretofore duly passed and adopted a resolution declaring its intention to change the boundaries of the zone or zones herein- after mentioned and described, and did fix a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and did duly hold and conduct such public hearing to consider said proposed change of zone or zones, and did receive evidence and reports from persons interested therein; and WHEREAS, within. a. period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by for- mal resolution its findings of facts and declare its opinions and reasons for recommending an amendment to said Title 18 of the Ana- heim Municipal Code to effect the proposed changes in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 1st day of October , 1968 ,as the time and the Council Chamber in the City Hall ~he City of Anaheim as the place for a public hearing upon said proposed change of zone or zones, and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone or zones in which it is now situated to a different zone or zones, as here- inafter set forth, is more suitable for the zone or zones in which it is now incorporated, and that a change of zone should not be granted. NOW~ THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit; PARCEL 1: -~~---.- Those portions of the Juan Yorba and Eduardo Poloreno , Allotments as per Decree of Partition of the Rancho Santiago de Santa Ana, recorded in book "B;i of Judgments of the 17th Judicial District Court of Los Angeles County, California and of Lot 4 and portions of Lots 5 and 3, as shown on the map of a Record of Survey of the land owned by E. Walter Pyne, filed in book 2, page 19, Record of Surveys, in the office of the County Recorder of said Orange County, described as follows: -1- 68-69-18 Beginning at a bolt marking the point of intersection of a curve concave to the Northwest with a radius of 1000 feet on the center line of the Santa Ana Canyon Road as described in deed to Orange County recorded June 7, 1928 in book 171, page 144 of Official Records (said point of intersection being approximately 121 feet Easterly along said center line from the West line of said Juan Yorba Allotment) i thence North 600 22' 55" East 688.16 feet along the tangent line of said curve and the center line of said Santa Ana Canyon Road, thence North 270 551 35" West 1134.39 feet to the compromise boundary line as shown on map filed in book 1, page 38, Record of Surveys, in the office of the County Recorder of said Orange County; thence South 670 54' 30" West 219.73 feet along said compromise line to the West line of said Juan Yorba Allotment; thence North 00 00' 30" West 119.37 feet along said West line to the North line of said Rancho Santiago de Santa Ana, as shown on map filed in book 15, page 31, Record of Surveys, in the office of the County Recorder of said Orange County; thence South 730 53' 14" ~'iest 120.70 feet along said North line to Station S. S. A. 380 thence South 00 07' East 10.72 feet to the South line of said Lot 5; thence North 740 54' East 27.42 feet to the Northwest corner of saia Lot 4; thence South 00 07' East 521.08 feet along the Westerly line of said Lots 4 and 3 to a concrete monument at an angle point in the West line of said Lot 3; thence North 890 53' East 65.08 feet along the Southerly line of the Northerly portion of said Lot 3 to a two inch pipe set in concrete on the boundary line of said Lot 3; thence South 30 52' 40" East 854.33 feet along the West line of said Lot 3 to the tangent line of said curve on the center line of said Santa Ana Canyon Road; thence i~orth 740 10' 25" East 88.33 feet to the point of beginning. PARCEL 2: - -.----- Beginning at a point in the center line of Santa Ana Canyon Road, as described in the deed recorded June 7, 1928 in Book 171, page 144 of Official Records, said point being located 688.16 feet North 600 22' 55" East from a bolt marking the point of intersection of a curve, said bolt Deing approximately 121.00 feet, more or less, Easterly along said highway from the West line of the Juan Yorba Allotment of the R~lCho Santiago de Santa Ana, from said point of beginning North 600 22' 55" East 478.84 feet along said center line, thence North 290 03' 2011 West 1073.71 feet to a point in a compromise boundary line as shown on a Map filet ir. Book 1, 2age 38 of Record of Surveys in the office of the County Recorder of Orange County, California; thence along said compromise line South 670 54' 30" ~\7est 459.85 feet to a point in a line drawn i'iorth 270 55' 35" V'ifest from the point of beginning; thence South 270 55' 35" East 1134.39 feet to the point of beginning. Except therefrom the soutneasterly 339.13 feet of the Northeasterly 174.10 feet thereof. -2- :t'emain in the Orange County A-l! Agricultural District Zoning, in which it is now incorporated, and that the proposed reclassification to R-2-5000, One-Family Zone, as well as the reclassification to R-l, One-Family Residential Zone, as recommended by the City Planning Commission in its Resolution No. PC68-267, be denied without prejudice.
