RESOLUTION NO. 68R-487
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 67R-685
GRANTING A HOUSE MOVING PERMIT TO MORRIS
DOMINO TO MOVE A DWELLING TO 17872 PERALTA
HILLS DRIVE, ANAHEIM, CALIFORNIA.
WHEREAS, the City Council did on December 12, 1967
adopt Resolution No. 67R-685 granting a house moving permit
to Morris Domino to move a dwelling house from 329 Via Lido
Soud, Newport Beach, California to 17872 Peralta Hills Drive,
Anaheim, California, subject to certain conditions therein
set forth, and subject to compliance with all of the provisions
of the Anaheim Municipal Code relating to the moving of
buildings from a point outside the City of Anaheim to a point
within the City; and
WHEREAS, Condition No. 3 of said resolution rea(~
as follows:
"3. That the Peralta Hills Drive frontage of the
entire original parcel shall be improved to
Peralta Hills standards, as adopted by the
City, prior to the issuance of a building
permit on any new parcel; provided, however,
that said requirements shall be waived upon
the posting with the City of a faithful
performance bond in an amount to be determined
by the City Engineer, or upon the payment to
the City of a cash bond, in an amount to be
determined by the City Engineer, to guarantee
said street improvements, and upon the execu-
tion of an agreement with the City providing
that the City of Anaheim shall be responsible
for the installation of street improvements
at such time as deemed necessary by the City. II
AND WHEREAS, thereafter, on August 6, 1968, the City
Council adopted Council Policy. No. 207 providing that:
"It is the policy of the City Council that in
the area known as Peralta Hills, the property
owners shall not be required to install additional
street improvements (curbs and gutters, paving,
sidewalks and storm drains) or street lighting
facilities, along presently dedicated streets, as
a condition of approval for a parcel map or of
occupancy of a residence under a Building Permit.
Any necessary easements for additional streets,
storm drains, sewers or other public utilities
shall be provided as required by the City Engineer
and/or Utilities Director.
It shall be the intent of the City Council that
any street which may be dedicated to the City
of Anaheim at a future date, or any private road-
way, which may be required as a portion of a
tract, parcel map or building permit, shall be
paved as required by the City Engineer to a

condition comparable to the existing public
streets in the Peralta Hills area.
It shall be the intent of the City Council
that at such time as requested by a majority
of property owners or as required by the City
of Anaheim to safeguard the health, welfare
and safety of the general public that these
improvements will be installed by formation
of an appropriate special assessment district."
AND WHEREAS, the City Council finds that, in view of
the adoption of the above-mentioned policy relating to street
improvements in the Peralta Hills Area, Condition No. 3 of
Resolution No. 67R-685 should be deleted.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that Resolution No. 67R-685 granting
a house moving permit to Morris Domino to move a dwelling to
17872 Peralta Hills Drive, Anaheim, California, be, and the
same is hereby amended by deleting therefrom Condition No.3.
BE IT FURTHER RESOLVED that in all other respects
said Resolution No. 67R-685 be, and remain in full force and
effect.
THE FOREGOING RESOLUTION is approved and signed by
me this 6th day of August, 1968.
