1968-474 RESOLUTION NO. 68R- 474 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACKNOWLEDGING RECEIPT OF A PETITION FOR THE ANNEXATION OF CERTAIN UNINHABITED TERRI- TORY TO THE CITY OF ANAHEIM, DESIGNATING THE TERRITORY AS THE LA PALMA-MIRALOMA ANNEXATION DESCRIBING THE BOUNDARIES OF THE TERRITORY PROPOSED TO BE ANNEXED AND GIVING NOTICE OF THE DAY, HOUR AND PLACE WHERE AND WHEN ANY PERSON OvlliING REAL PROPERTY WITHIN SUCH TERRITORY SO PROPOSED TO BE ANNEXED MAY APPEAR BEFORE THE CITY COUNCIL AND SHOW CAUSE WHY SUCH TERRITORY SHOULD NOT BE ANNEXED TO THE CITY OF ANAHEIM. WHEREAS, the City Council of the City of Anaheim did on the 30th day of JulX ' 19~, receive a written petition asking that certaln new territory described in said petition be annexed to the City of Anaheim; and WHEREAS, prior to the circu~ation or filing of said petition, notice of intention to annex said territory, contain- ing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission; and WHEREAS, said Local Agency Formation Commission has rendered its decision, as provided in Section 54707 of the Government Code, approving said annexation; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim and is uninhabited territory, and said petition contained a description of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council finds from evidence and reports received that at the time of the filing and receipt of said petition, it \vas and now is signed by owners of not less than one-fourth (1/4) of the land in the territory by area and by assessed value in the territory proposed to be annexed, according to the last preceding equalized county assessment roll; and KHEREAS, the City Council finds from evidence and reports received and from said petition that at the time of the filing and presentation of said petition that said new territory proposed to be annexed to said City of Anaheim did not form a part of any municipal corporation and that said territory was uninhabIted and is contiguous to the City of Anaheim; and WHEREAS, the City Council finds from said petition and evidence and reports received that the boundaries of the territory so proposed to be annexed to the City of Anaheim are as follows, to wit: -1- -"'""~-' ..",.,. --""-^"'~'-"'.'~---""'---''<'-._-----..-_.,- ... ...._-~.,--'''..- ......~.._- .._._-" LA PALMA - MIRALOMA ANNEXATION TO THE CITY OF ANAHEIM' That parcel of land located in the County of Orange, State of California, described as follows: Beginning at a point in the existing City Limit line of the City of Anaheim, said point being the intersection of the Nor~h- erly right of way line of White Star Avenue, formerly La Pal~~ Avenue (40 feet wide) with the Westerly line of Lot 159 of the Eucalyptus Forest Tract, as shown on a Map recorded in Book 5, pages 29 and 30 of Miscellaneous Maps, records of Orange County, California, as established by the Blue Gum - Coronado Annexa- tion to the City of Anaheim, passed by Ordinance No. 2309, July 12, 1966 and filed with the Secretary of State August 15, 1966 and recorded August 22, 1966 in the office of the County Re- corder' of Orange County, California; thence Following along the said existing City Limit line of the City of Anaheim the following courses and distances: North 160 17' West 401.67 feet, more or less, along the Westerly line of said Lot 159 and the Northerly prolongation thereof to an intersection with the centerline 'of Santa Ana Street, 40 feet wide, as shown on the Map of said Eucalyptus Forest Tract, re- corded in Book 5, pages 29 and 30 of Miscellaneous Maps, records o~ Orange County, California, said Santa Ana Street having been abandoned by Order of the Board of Supervisors of Orange County, January 16, 1917, recorded in Book 12, page 317 of Deeds, re- cords of Orange County, California; thence North 730 43' East 115.87 feet, more or less, along the centerline of said Santa Ana Street, to an intersection with the Easterly line of that certain parcel of land conveyed to the County of Orange by deed recorded August 7, 1962 in Book 6204, pages 797 through 801, inclusive, of Official Records of Orange County, California; thence Following along a portion of the Easterly line of the land conveyed to said County of Orange in the last mentioned deed, the following courses and distances: North 430 31' 42" West 64.65 feet" more or less, to the beginning of a tangent curve concave Northeasterly and having a radius of 550 feet; thence South 160 17' East 350 feet, more or less, along the last mentioned parallel line to the Southwest corner of Lot 124 of the said Eucalyptus Forest Tract; thence North 730 43' East 1042 feet, more or less, to an intersec- tion wi th the East line of the We., t 6 feet of Lot 132 of said Eucalyptus Forest Tract; thence North 160 17' West 310 feet, more or less, along the East- erly line of the West 6 feet of said Lot 132 to an intersection with a line parallel with and 20 feet Southerly, as measured at right angles from the centerline of the aforementioned Coronado Street; thence North 160 17' West 640 feet, more or less, along the last mentioned parallel line to an intersection with a line parallel with and 20 feet Southerly, as measured at right angles, from the centerline of Miraloma Avenue, formerly known as Anaheim Road, said point of intersection being a point in the existing City Limit line of the City of Anaheim, as established by the North- east Annexation No. 2-A to the City of Anaheim, passed by Ordi- nance No. l269, August 12, 1958, filed with the Secretary of State September 12, 1958 and recorded September 17, 1958 in Official Records of Orange County, Calrrornia; Annexation and that notice of such proposed annexation be hereby given as hereinafter provided. BE IT FURTHER RESOLVED that a public hearing shall be had upon the date set, not less than forty (40) nor more than sixty (60) days after the passage of this resolution, unless the owner or owners of all of the territory to be annexed have peti- tioned for annexation or filed their consents to such annexation, in writing, with the City Council in which event the hearing shall be set at any time after compliance with Section 35311 of the Government Code. BE IT FURTHER RESOLVED that the City Council does find that the owner or owners of all of the territory proposed to be annexed have not petitioned for annexation or filed their consents to such annexation, in writing, with the City Council. BE IT FURTHER RESOLVED that the 24th day of September 1968 , at the hour of 1:30 o'clock ~M., at the City Council Chamber in the City Hall of the City of Anaheim be, and the same is hereby, fixed as the day, hour and place when and where the City Council will hear protests made by any owner or owners of real property within the territory proposed to be annexed; and that at any time before the closing of said hearing on protests, any owner of property within said territory may file with the City Clerk a written protest against the annexation. Said protest shall be in writing and shall state the name of the owner of the property affected and the description and area of the property in general terms. BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized and directed to cause a copy of this reso- lution to be published at least twice, but not oftener than once a week, in a newspaper of general circulation, published in the City, to wit: The Anaheim Bulletin of Anaheim, Orange County, California, and also in a newspaper of general circula- tion, published outside of the City, but in the County of Orange, in which is located the territory hereinabove proposed to be annexed to the City of Anaheim, to wit: The Placentia ('onr;pr and that such publication shall be completed at least twenty (20) days prior to the date of hearing herein- above specified. AND BE IT FURTHER RESOLVED that the City Clerk of the City of Anaheim be, and she is hereby, authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed, in the last equalized county assessment roll available on the date the proceedings were initiated, at the address shown on said assessment roll or as known to said City Clerk, and to any person who has filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said Clerk; and in the event that land within the territory proposed to be annexed to the City of Anaheim is owned by a County, the City Clerk of the City of Anaheim shall also cause written notice of such proposed annexa- tion to be mailed to the Board of Supervisors of such County.
