1968-454 RESOLUTION NO. 68R-454 A RESOLUTION OF THE CITY COu~CIL OF THE CITY OF ANAHEIM GRANTING VARIANCE NO. 1995. W~EREAS, the City Planning Commission of the City of Anaheim did receive a petition for zoning variance from CLARK W. WINGERT, JR., et al., owners of certain real property situated in the City of Anaheim, County of Orange, State of California, describea as follows: Parcell: The south half of the southeast quarter of the northeast quarter of Section 12, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, Page 10 of ~riscellaneous Maps, in the Office of the County Recorder of said County. EXCEPT that portion thereof described in the deed to the State of California recorded March 5, 1965 in Book 7435, Page 200 of Official Records. Parcel 2: That portion of the west half of the northeast quarter of the southeast quarter of Section 12, Township 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, Page 10 of Miscellaneous Maps, in the Office of the County Recorder of said County, described as follows: Beginning at the intersection of the center lines of Rio Vista Street and Lincoln Avenue, formerly Anaheim-Olive Road as said intersection is shown on map of Tract No. 3824, recorded in Book 146, Pages 4 and 5 of said Miscellaneous IVlaps; thence north 010031 49" East 113.02 feet along said center line of Rio Vista Street; thence north 880 561 1111 west 40.00 feet; thence south 500 391 41" west 62.01 feet to a line parallel with and northerly 55.00 feet from said center line of Lincoln Avenue; thence north 780 011 24" west 229.00 feet along said parallel line; thence north 600 471 47" west 270.12 feet; thence north 460 251 39" west 151.35 feet to the easterly line of said west half and the true point of beginning, thence north 460 251 39" west 482.73 feet to the beginning of a curve concave northeast- erly having a radius of 450.00 feet; thence northwesterly 351.88 feet along said curve through a central angle of 440 481 12"; thence north 010 37' 27" West 73.80 feet to the northerly line of said southeast quarter; thence south 890 141 48" east 505.13 feet along said northerly line to said easterly line of said west half; thence south 10 051 36" West 713.27 feet along said easterly line to the true point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said petition on July 1, 1968, notice of which said public hearing was duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- ^'-""_...._.....~.....-._,_._-- WHEREAS, said City Planning Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. PC68-200, recommending that Variance No. 1995 be granted, subject to cer- tain conditions therein set forth; and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in granting said variance and did set a public hearing thereon to be held on the 30th day of July, 1968, at 1:30 olclock P.M. in the City Hall in the City of Anaheim and notice of such public hearing was duly given as re- quired by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, after due investigation and studies made by itself and in its behalf, and after due consideration of all the evidence and reports offered at said hearing, the City Council does find and determine that: 1. There are exceptional or extraordinary circum- stances or conditions applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 2. That such a variance is necessary for the preser- vation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone and denied to the property in question. 3. That the granting of such variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 4. That the granting of such variance will not adversely affect the comprehensive general zoning plan. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a conditional zoning variance be, and the same is hereby granted permitting waivers of the following Anaheim Municipal Code requirements or limitations on the property hereinbefore described, to permit the subdivision of said property into 107 R-l Zone lots: (a) A waiver of the minimum lot width (Section 18.24.030(4-a)); (b) A waiver of the minimum lot area (Section 18.24.030 (4-a)); (c) A waiver of the minimum floor area per dwelling unit (Section 18.80.090); and (d) A waiver of the minimum front yard area (Section 18.24.030). -2- ,~_ ___'~"'.~'''''_' O'~I>-""_."""_ _.<>. .,"'or_",.",,,_,,,,,, ',..".., _"'."'"....._~,=-.-_....._____~.__-"- ".__~_~v,.___ That said variance is granted subject to the following conditions: 1. That this variance is granted subject to the com- pletion of Reclassification Proceedings No. 68-69-4 now pending. 2. That subject property shall be developed substantially in accordance with renderings on file with the City of Anaheim; provided, however, that the northerly lots of subject property, abutting R-l, 7200 square foot lots, shall be not less than 65 x 100 feet in size, and that the remainder of the lots shall be not less than 5500 square foot lots. The City Council hereby reserves the right to revoke such variance permit for good cause or failure of said owners, their heirs, successors or assigns, to comply with the Anaheim Municipal Code and regulations and the conditions herein. Said variance is granted for the term prescribed by the Anaheim Municipal Code unless otherwise specified herein. THE FOREGOING RESOLUTION is approved and signed by me this 30th day of July, 1968.
