However, since sub~ect petition had been originally acheduled for October 5, 1970, and pre~ious~continuances had been granted, the Commission might wish to consider removing the item from the agenda, and at such time _ as the petitioners had auccessfully negotiated purchase of the property from the State, there•might be more property to consider, and, therefare, the ~,,.;., ...,~"~ petition taould have to be read~~ertiaed. i`~ Commissioner Farano offered a motion to remove consideration of Conditional .~ . ENGINEER: Williamson REVISION N0. 1 & Schmid, 1535 East First Street, Santa Ana, California. `' Sub~ect tract, located on the east side of Rio Vista Street, ~`'- south of Frontera Street and containing approximately 15 acres, is proposed for subdivision into 4 R-3 zoned lots. Assistant Zoning Supervisor Malcolm Slaughter reviewed the location of sub~ect ~ property and uses established in close proxim3ty, noting that R-3 zoning had .-:j been approved for the property, and a conditional use permit was recently approved to permit development of a condominium subdivision; therefore, this tract and Tract No. 7219 now before the Commission would implement said zoning and conditional use permit. '~~ The Commiasion reviewed the tract maps and then inquired whether Lot No. 4 = of Tract No. 7218 - ttie recreation area lot - would serve both tracts, and _%2 how was thia to be gov~erned. ,.,~: .. Zoning Supervisor Charles Roberts noted that Lot No. 4 would serve as the recreation area for both Tract Nos. 7218 and 7219, and that this would be ,;;+ governed by the CC&Ra. ° The Commisaion then inquired as to the exact length of the recraatior, lot and whether there were any plans for the recreation area. ~`>> Mr. Larry Matzick, representing the developer, appeared befor•e the Commission and advised the Comwiasion that he did not know the exact •length of said lot, but it was more than 3/4 of an acre in stze; that a swimming pool, t;o•Eether with a change area an3 rest room facilities were proposed for the recre,'ation area; that the balance, at the .present time, was planned aa a green belt area ' with walkways, etc. - however, later the homeowners might decide that a ~ ,;:a, volleyball cour~ or other types of play areas should be placed there; and ; that since this would be under community ownership, it would be inc~uded in ~~ the CC&Rs. The Commission further inquire4 whether or not each property owner would be `~' assessed a fee for~the implementation of the CC&Rs and maintenance of the landscaping and buildings. " Mr. Matzick replied that each unit owner would be assessed a given amount - ~., however, this money would be placed into a separate account, and that the buildings and trim would be painted every five years, as well as other `?~',-`° general maintenance costs including the landscaping areas. ITEM N0. 2 LINCOLN-MONTEREY ANNEXATION - INHABITED - Property located generally west of Brookhu;st Street on the south aide of Lincoin Avenue and is presently zoned for commercial and multiple-family residentia7 usea in the County of Orange. Assistaat Zoning Supervisor HIalcolm Slaughter reviewed the proposed annexation and its location, noting that the property was primarily developed with a 232-unit apartment complex; that under State law, an inhabited anaexation requires that the,Planning Commission submit a report and recommendation to the City `Council as to the appropriate- nesa of the annexation; and tha-t no annexation election will be required becaiiae 100X of'th,e property owners have agreed to annexation. Furthermnre, thie property was a portion of the "Gaza strip", Commissioner Raywood offered a aotion to recommend to the City Council that the proposed Lincoln-Monterey Annexation appeared to be a logical extension of the City of Anaheim boundaries. ITEM N0, 4 CONDITIONAL USE PERMIT N0. 1101 (Quality Hotels) Property located at the aouthwest corner of Harbor Boulevard and Convention Way - Request for approval of reviaed plans. Asaistant Zoning Supervisor Malcolm Slaughter reviewed the location af sub~ect property and the request for approv~l of revised plans to estab- lish a hotel and restaurant complex exceeding 75 feet in height and noted that the reviaed plans now propose in addition to the previously- approved nine-story and one-story building to construct a six-story tower to the rear of the nine-story tower which would provide for addi- tional rooma; and that the plot plan had been revised to permit better ingress and egrass to the property during heavy traffic periods - particularly when events scheduled at the Convention Center were letting out.
