The proponents in applications which are not contested will have five minutes to present their evidence. Additional time will be granted upon request if, in the opinion of the Commission, such additional time will produce evidence important to the Commission's consideration. 2. In contested applications, the proponents and opponent will each be ~'"`~ given ten minutes to present his case unless additional time is ~;.,~• requested and the complexity of the matter warrants. The Commission's considerations are not determined by the length of time a participant speaks, but rather by what he says. 3. Staff Reports are part of the evidence deemed received by the Commission in each hearing. Copies are available to the public prior to the meeting. 4. The Commission will withhold questions until the public hearing is closed. 5. The Commission reserves the rig.~it to deviate from the foregoing if, in its opinion, the ends of fairness to all concerned will be served. 6. All documents are presented to the Planning Commission for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary evidence, shall be retained by the Commission for the public record and shall be available for public inspections. 7. At the end of the scheduled hearings, members of the public will be allowed to speak on items of interest which are within the jurisdiction of the Planning Commission, and/or agenda items. OPPOSITION: None PETITIONER'S COMMENTS: Request is due to widening of Ball Road by CALTRANS, want to rebuild with food mart, with beer & wine sales, revised plans to met minimum square footage requirements for beer & wine, ~~=°~~ currently in condemnation prceedings with CALTRANS. .~,,c:r STAFF COMMENTS: (Traffic Engineer) (1) Dedication requirement is the ultimate right of way, and in no way affects negotiations between applicant and CALTRANS; (2) Adequate space to accommodate the type of traffic that will be frequenting site since most of the traffic is heading to the freeway which is different than sites on arterial streets. COMMISSION COMMENTS: (1) Questioned only one restroom proposed, lot of tourists expected in that area; Planning Commission has been requesting separate men and women's restrooms for about six months, and that restrooms must be properly supplied and maintained; (2) this was service station prior to condemnation and now wants to intensify use with convenience store and the sale of beer and wine next to the entrance to the freeway; parking waiver is necessary and felt since Code requires a parking study before waiver can be granted, t:~at the study should be submitted, even though traffic engineer had indicated the parking waiver could be granted; (3) felt people likely to drink beer purchased at facility after getting on the freeway; asked if Code could be changed to allow market without beer and wine; (4) study currently being done of CR area - will be finished in 7 or 8 months and staff indicated the portion of study dealing only with the retail uses could possibly be done in a few months. COMMISSION COMMENTS: Improvement since the units would be condominiums instead of apartments; however, they will be rented as apartmentrs for awhile.
