MINUTES OF July 18, 1988 - APPROVED ALL COMMISSIONERS PRESENT PUBLIC HEARING (PUBLIC TESTIMONY) 1:30 P.M. PROCEDURE TO EXPEDITE PLANNING COMMISSION PUBLIC HEARINGS 1. The proponents in applications which are not contested will have five minutes to present their evidence. Additional time will be granted upon request if, in the opinion of the Commission, such additional time will produce evidence important to the Commission's consideration. 2. In contested applications, the proponents and opponent will each be given ten minutes to present his case unless additional time is requested and *_he complexity of the matter warrants. The Commission's considerations are not determined by the length of time a participant speaks, but rather by what he says. 3. Staff Reports are part of the evidence deemed received by the Commission in each hearing. Copies are available to the public prior to the meeting. 4. The Commission will withhold questions until the public hearing is closed. 5. The Commission reserves the right to deviate from the foregoing if, in its opinion, the ends of fairness to all concerned will be served. G. All documents are presented to the Planning Commission for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary e~~denre, shall be retained by the Commission for the public record and shall be available for public inspections. 7. At the end of the scheduled hearings, members of the public will be allowed t~ speak on items of interest which are within the jurisdiction of the Planning Commission, and/or agenda items. Been in existence for three years and there h~-ve bean ..io problems with traffic and they are ,requesting approval of drive-t.~r•~ugh lane without having to pay 1/4 the cost of installation of the signal. COMMISSION COMMENTS: Use has been in existence fox three years, with no problems; Cabot, Cabot & Forbes paid only $8,000 for traffic signal installation for a much larger project and felt this developer should not be expected to pay more than their fair share. (Developer agreed to pay $8,300 rather than $25,000 as origin~.lly requested). Determined fair share has been paid with fees when property was developed. STAFF COMMENTS: Traffic signal was desire of Planning Commission three years ago. Traffic Engineer stated parking and drive through lane are adequate. ACTION: Granted, i~eleted Condition No. 1, pertaining to payment for traffic signal installation, since fees for signal assessment have already been paid Petitioner stipulated to eliminate the sale of beer & wine.
