The proponents in applications which are not contested will have five minutes to present their evidence. Additional time will be granted upon ,,-.. .request if, in the opinion of the Commission, such additional time will V produce evidence important to the Commission's consideration. 2. In contested applications, the proponents and opponent will each be given ten minutes to present his case unless additional time is requested and the complexity of the matter warrants. The Commission's considerations are not determined by the length of. time a participant speaks, but rather by what he says. 3. Staff Reports are part of the evidence deemed received by the Commission in each hearing. Copies are available to the public prior to the meeting. 4. The Commission will withhold questions until the public hearing is closed. 5. The Commission reserves the right to deviate from the foregoing if, in its opinion, the ends of. fairness to all concerned will be served. 6. All documents are presented to the Planning Commission for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary evidence, shall be retained by the Commission for the public record and shall be available for public inspections. 7. Buses to LAX start at 4:OOa.m. and the buses brake in front of their homes. Have concerns over responses to initial EIR. Parking is generally not a problem because most people will not have cars. PETITIONER'S COMMENTS: They meet all new and existing Codes; this will be upgraded to a class A hotel; asked for a reduction in the Transient Occupancy tax from 309, to 209,; could have an ordinance to preclude buses from parking along Walnut. Would like to have more landscaping then what Code requires and 14 fewer parking spaces. COMMISSION COMMENTS: Try to eliminate noise from buses in the morning; should not allow buses to stage on Walnut Street; problem with buses pulling in under the Porte cochere and loading and unloading in the mornings. Four to 5-foot berm should be installed along Walnut street; air pollution should be solved by new ordinance. STAFF COMMENTS: Paul Singer, City Traffic Engineer, stated by relocating the lobby to Ball Road, some reduction of to~:.r buses may be anticipated. The actual destination of the tour buses is the CR area; they will most likely travel westbound on Ball Road and try to make a left-turn into the project and this is not practical; they will enter Walnut Street and enter the project on the northern driveway on Walnut Street and pick-up passengers at the L-shaped driveway and then exit on Ball Road. The pork chop island on the southerly driveway on Walnut Street will not be very effective. Approved Approved Granted 4/23/90 Page No. 3 Nancy Ferguson, Planning, stated their impression was that air pollution and noise came from the staging problem off-site. The applicant assured `"' them the number of buses that would be pulling into the Conestoga as a time share would be significantly reduced to about 6 a day because they were not going to have tour buses and therefore, did not require further analysis of the noise. Selma Mann, Deputy City Attorney, clarified there is no EIR on this project, but that they are working with a Mitigated Negative Declaration. The CEQA findings as presented includes certain mitigated measures which reduce EIR impacts to a level of insignificance. If, as a result of public comments, there are additional impacts that are present, the Planning Commission can place additional mitigation measures to reduce impacts to a level of insignificance. ACTION: CEOA Mitiaated Native Declaration - Approved Must provide a 4 to 5-foot berm along Walnut Street (petitioner asked for this flexibility). This is subject to the City Traffic Engineer's approval for visibility. Circulation improvement for exit on Ball Road to be done within 90-days from date parcel is secured. Waiver of Code Requirement - Approved If parking is not sufficient after build-out, petitioner to stipulate they will increase parking 14 spaces. (It is _ petitioner's prerogative to use the excess landscaping if he so desires). Conditional Use Permit No. 3258 - Granted Subject to the Transient Occupancy Taxes collected for the Vacation Ownership 'Jr.its be reduced to 25~ as opposed to 30~ as stated in condition no. 28 on page 20 of staff report. PETITIONER'S COMMENTS: Ritz been there 6 years, and there have been no problems, have upgraded property, building permits approved for increased floor area, and currently working with Health Dept. & ABC; several bars in this area, could take measures to mitigate noise, 9 security personnel, entire parking area available, reciprocal parking agreements, open 3 nights (Fri. Sat & Sun 9 p.m. to 1:30 a.m.); and there is an age restriction and security does check identifications. COMMISSION COMMENTS: Restaurant is not really a full restaurant, just serves fast foods; staff report indicates hours of operation 7 days a week; original permit for only 3 nights a week, but they have had dancing on Thursday nights; have expanded without benefit of permits; landscaping has not been put in; not in favor of dance hall that serves alcohol, detrimental to neighbors; with noise problems neighbors are having now, should not be expanded; suggested use should be operated under original conditions and not expanded; wrong place for dance hall backing up to residences; should do acoustical treatment in order to continue operating under old CUP . Felt competition is good. Cannot compete with the other center's rents. COMMISSION COMMENTS: Clarified two additional signs are being requested and identification of same two tenants on the monument sign. Did not think this is an integrated center. STAFF COMMENTS: Felt matter should be continued so unanswered issues can be addressed, information about a meeting held with property owners and agreements met and there are discrepancies, some of the property ~,.,.~ owners had left meeting early an~i should be present. Plans in file show this is site for hotel; problems with parking and narrow streets, and red curb could affect other properties. Engineering - only one driveway is on this property. Parking was originally analysed for entire center and did not see continued parcelization of the site.
