The proponents in applicatiens which are not contested will have five minutes to present their evidence. Additional time will be granted upon request if, in the opinion of the Commission, such additional time will produce evidence important to the Commission's consideration. 2. In contested applications, the proponents and opponent will each be given ten minutes to present his case unless additional time is requested and the complexity of the matter warrants. The Commission's considerations are not determined by the length of time a participant speaks, but rather by what he says. 3. Staff Reports are part of the evidence deemed received by the Commission in each hearing. Copies are available to the public prior to the meeting. 4. The Commission will withhold questions until the public hearing is closed. 5. The Commission reserves the right to deviate froc; the foregoing if, in its opinion, the ends of fairness to all concerned will be served. 6. All documents are presented to the Planning Commission for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary evidence, shall be retained by the Commission for the public record and shall be available for public inspections 7. At the end of the scheduled hearings, members of the public will be allowed to speak on items of interest which are within the jurisdiction of the Planning Commission, and or agenda items. STAFF COMMENTS: Leonard McGhee, Senior Planner, tried to contact the applicant, however, he was unable to locate him. Applicant was aware there was a meeting today as they spoke with him last Thursday. PETITIONER'S COMMENTS: The last CUP expired withou•: paying the fees and he had to resubmit; he explained he did not have the funds at the time; has 3 children and dose not have anymore traffic then anyone else in the neighborhood; a bus picks up hie mother-in-law and takes her to the Srail Institute twice a week; hie children has friends and he wants them at hie house so he knows where hie children are. COMMISSION COMMENTS: If this ie approved, the conditions statb that the person occupying the "granny" unit must pay no rent and moat be 62 years or older; the only issue before the Planning Commission today is the "yranny" unit; if there are additional problems regarding traffic, noise or working on care, then concerned individuals should contact Code Enforcement and they will investigate those concerns. Code Enforcement records indicate that they have been with Mr. Messina for the past 3 years trying to get the "grancy" unit matter resolved; this has been an ongoing problem; there have been conaidc+rable complaints with the neighbors in the area with a constant flow of people to the ~ {?~ residence; at the last PC meeting they did indicate other family members visit on the average of twice a month with up to 9 ar 10 people; they have had no other complaints since the last meeting other than failure to comply with the CUP requirements. OPPOSITION: None PETITIONER'S COMMENTS: Approached exhibit board and explained the exhibits; the old building had to be removed because there were ~~ underground storage tanks too near its foundation; when they moved the tanks, the building started to cave and they had to remove the building for safety reasons; the new building is designed in a new configuration; new station to be a full service station rather then a self serve station; would like to work with City to relocate the transformer to another location; if he dedicates 2-1/2 feet and the church dedicatee 2-1/2 feet, would like utilities undergrounded. Mr. Templeton explained it would be up to the property owner whose service it is to provide them with a transition from the underground to the overhead fed service, but if the applicant could provide them with conduit then they could put in their conductors and service it from the underground source. Can wires go ~:ver the building and Mr. Templeton explained they cannot go over the building on the other property--they can pass over the building of the property which it serves. Commission - If underground utilities, can building qo above the wires and Mr. Templeton indicated it could not. Commission - Applicant has already lost frontage on Anaheim Blvd. Commission - Applicant could dedicate 2-1/2 feet and so could the church. Parking issues were discussed and it was agreed that parking will be across the street; applicant owns the property across the street and will provide a reciprocal parking agreement.
