The proponents in applications which are not contested will have five minutes to present their evidence. Additional time will be granted upon request H, In the opinion of the Commission, such additional time will produce evidence important to the Commission's consideration. 2. In contested appilcations, the proponents and opponent will each be given ten minutes to present their case unless additional time is requested and the complexity of the matter warrants. The Commission's considerations are not determined by the length of time a part(cipant speaks, but rather by what is said. 3. He is representing Temple Beth Emet on the location of the mobile ~ home that is on the property. They are aware it needs to be relocated and will do that with minimal Impact. He referenced the drawings. He explained there has been a request that they go 10 feet from the property line. As it stands now it is 6 feet off of the property Ifne. The request is to place it somewhat on an angle. In reviewing the documents he understands there is a request based on Code that there should be a 15•foot setback. He explained if they were going to go 15 feet from the property line, the best way to locate it would be to simply move it 15 feet off of the property Ifne and leave k in that position. At that distance from the wall wRh a series of plants along the wall, the Ifne-of-site tends to make h less noticeable or obtrusive as h is when it Is closer to the wall. If they place ft In any other direction h would substantially encroach on the parking lot and take one driveway. He elaborated. He stated since this is a conditional use permit and it causes them to come back often, they would like to see this based on a 10 year extension rather then 3 years because there will be no changes, h Just means they need to come back every 3 years to do the same thing over again. ~ Page 2 OPPOSITION: Clarence Owen, 1803 Harle Avenue, Anaheim, CA, right next door to the trailer. !, They have a sewer system line in running parallel wfth the wal and electrical and telephone. He asked with as much acroage as they have, why dkf they not put it somewhere where h would not be next to their home? For the last several years, they have had to keep their bedroom windows closed; their bathroom windows closed because a trailer is up higher looking onto their home. They live In a residential neighborhood. They did complain to the Temple and have met with them several times. The trailer is 54 feet; it is para''ei to the wall and it extends out from his home 24 feet. He elaborated. They did some measuring and determined that the trailer should be diagonal and perpendicular to the wall. He stated they have an evaporative cooler outside and it is very nolsey. If they do move the trailer diagonally, it would be farther away and that should help mitigate the noise along with some shrubbery. He is not asking them to move the utilities. He stated cars are being stopped at the end of their street; people Jump over the wall and drug deal. He sta:sd he thought they were suppose to close the gate at 11:OOp.m., but k has not been closed. He added there is also prostitution. He asked that this not be made permanent because k the other things persist that he just discussed, then this neighborhood will be back before the Commission. They are not opposed to approving h for 3 years. .., Theresa Fodor, 1807 Hade Avenue. She stated they have only received 2 notices from the Planning Commission about this. They received the original notice back In 1982 and this one-they never received a notification on a conditional use permit although they have changed the trailer twice during that time. REBUTTAL: Mr. Winnick stated their intent was not to irritate the neighbors and he was most distressed to hear what he has heard because he does not live there and we was not aware of some of the things he has heard and he did not think that should be tolerated for a m(nute. He stated he knows the gate is suppose to be closed and he does not see any reason why h should not be closed at 1 t:0op.m. He stated he thought they could make this work with a 10-foot setback as requested in the plan that the neighbors submitted. They measured and he understands that they would not have a problem fF the trailer was somewhat at an angle. They could also cut the towing hitch off of the trailer and place it at an angle where it does not encroach, but a little, on the driving area. THE PUBLIC HEARING WAS CLOSED. '~ ~ Page 3 ~ Jonathan Borcego, Senior Planner, stated ff the Planning Commission wants to proceed today that they add a condition requiring the relocation to be subject to '~ review by the City's Traffic and Transportation Manager in order to ensure that adequate circulation of traffic an the property is maintained. Also, if k Is the Planning Commission's desire to approve this trailer at a setback of 10 feet from the property line as opposed to 15 feet, that as a part of their findings they make a determination that Code Section 18.04.042.020 does not apply to a residential structure In conjunction with the church facility. Commissioner Masse stated that Is the vray the Planning Commission thought of at the initial time they gave approval of this CUP. He explained it was called out as a 10-foot without a variance. Chairman Henninger asked when they Issue this CUP and they change the mobile home periodically, that's not the subject of a new CUP. Mr. Borrego explained anytime there is a change to the mobile home or to the location of it, they should, at a minimum, run ff by the Planning Department. He added k could be approved administratively ff there was no additional impact beyond what the original trailer had. Further dialog took place regarding the :^cation of the trailer. He is the Property Manager for the property In question taiay. They have had a vacancy at this property for the last year. The tenant that is there is looking at taking that for additional space. It is the cleanest auto repair facility they have as a tenant and he has been exceptional. Thare have never been any problems with parking and i~~ay have not had one complaint since this use has been there. He asked that there not be a time Iimftation on the CUP. THE PUBLIC HEARING WAS CLOSED. Jonathan Borrego, Senior Planner, stated he had a slight amendment to Condition No. 6, page 5 of the staff report. He explained they would get compliance with those conditions even in the event that a building permft was not necessary for the Improvements they were going to be doing there. Chairman Henninger stated that the Redevelopment Commission asks that we put a time Ilmit on this and he noticed it was not included in the conditions of Approval. Mr. Borrego explained they felt that this particular user did actually serve the inductrlal community and that he t:.iderstands he does do some Meet maintenance. OPPOSITION: None PETITIONER: Wally Courtney, owner of property at 500 S. Anaheim Bivd. He explained about `l~ a year ago, one of his tenants, Mr. Mendoza, came in and asked for a CUP for automotive repair which was granted for one-year with the possibility of time eMenslons. They are requesting that time extension today. He stated they are hoping they do not have to come back year after year after year and pay the fees and go through the process, so they ask that the wording be modified. There was some confusion in the wording of the condition. THE PUBLIC HEARING WAS CLOSED. Jonathan Borego, Senior Planner, explained the amended condition should acutally read "one additional year to expiro on April 6, 1994.' He further explained that although this use has not boon a problem, there are some other issues that need to be addressed and for that reason, they were recommending one addtional year as opposed to eliminating the condtlon altogether. Chairman Henninger asked if things were right, then would staff be open to some additional modification? Mr. Borrego indicated that was correct-efther modified for an addtfonal time or delete ft altogether. Page 7 Chairman Henninger asked ff they have handled this in a slightly different way in some other cases where they have put in a condition that this be subject to Code enforcement examinations, and that they would then have to pay foY1 Mr. Borrego stated h depends on the degree of the v(olations which are being found on the property and in this particular case k was felt that the violations were minor enough that they could have been resolved rather quicMy, but this has dragged on longer then usual and as he understands K, there is another violation out there which may have come up recently. He asked Mr. Courney ff another auto repair business has since moved out there adjacent to the radiator shop? Mr. Courtney explained they were Interested In moving Into a vacant space in the building; he told them they needed'o get a (•UP. They came down to the Clry, applied for a business license and they were told that the existing CUP would cover it. Regardless of that, they did not last, and that space Is vacant. The reason Mr. Mendoza is requesting not to come back every year Is because his first year has been successful and he wants to start Investing money Into the property to buy more equipment, etc. and he does not want to have to go out and spend a lot of money and then have to come back a year later and find that he has to go through another public hearing. As far as any other Code Enforcement problems, Code Enforcement made a Ilst of minor things, none of which affect the subject property we are talking about. They did mention a couple of possible Fire Code violatlons, however, he has never been Informed of any. He explained he did ge: a notice of an unoperable vehicle. He explained and discussion took place between Mr. Courtney and the Commission about other Inoperable vehicles on the premises. Commissioner Peraza stated the Improvements on the parking are good, however, In the alleyway, he thought they were suppose to put In some parking stalls. fAr. Courtney explained he is talking to the Ciry about the fact that there is some type of question about the City having drainage come down Claudina Street, run across this property down the alley and then accessing into the sewer on Anaheim Blvd. There is some question as to who is suppose to Improve that street drainage. They are waiting to resolve that problem. He did speak with the Flre Department and they do not consider the alley a fire zone or access. They do not care if they block h or not, h is up to the tenants to work their way around each other if they are using the alley for aarking. Commissioner Peraza asked ff there was something about not storing vehicles outside? Mr. Borrego stated no vehicles should be stored outside on a long term basis. The biggest concern they have about that portion of the property is that one of the conditions of the original conditional use permit, when ft was granted, was that the parking plan for the property be presented to the Traffic and Transportation Manager for review and approval and subsequently that the parking area be developed to that standard. Page 8 i The parking plan was submitted to the Traffic Engineering Division and they did approve the plan, however, k appears in the Inspection that he made, only a • portion of the property was resurfaced and restriped, that being the rear portion. The alley area where the vehicles are stored is actually a.designated parking area under the orginal conditional use permft and as such R should be resurfaced and restriped accordingly. Discussion took place regarding the cars wfth flat tires that were parked in the alley. Mr. Mendoza explained he was working on these cars. Commissioner Boydstun suggested they extend this to 2 or 3 years because he has a clean bill of health, and that it has been other problems. Chairman Henninger suggested they make this for the term of the lease (approximately 18 mos.). Mr. Mendoza stated that would be alright. Requesting reclassification of subject property and the approval of the condftionai use permit to permit an automotNe repair facility. OPPOSITION: Paul Kott, 1225 W. Uncoln Avenue, Anaheim, CA. There (s an extreme problem with transiency, drug dealing, prostitution and many gang bangers in and around West Street/Lincoln Avenue. He does not believe this business would contribute to that. The City should be careful about making decisions from the I.5 to the downtown area; that section of Uncoln Avenue is going to be the gateway Into the new downtown corridor from the I-5. The I-5 is scheduled to widen at Lincoln Avenue in 1996 and also at that time, Lincoln Avernie is also going to be widened from 2 to 3 lenes on each side. He did not feel that an automotive repair use should be in the gateway window from the I-5 Freeway. ~' Page 10 II d i REBUTTAL: Mr. Phan stated his service did not have anything to do with drugs or any kind of i~ prostitution. THE PUBLIC HEARING WAS CLOSED. Alfred Yalda, Traffic Engineering, stated he was not aware of any Improvement on Lincoln Avenue for the neM 5-8 years except the area that is going to be Impacted by the I.5 widening. Eventually Lincoln Avsnue must be to fts ultimate width, but he did notth(nk there was any plan to do h within the next 2 or 3 years. Commissioner Messe stated he looked at other transmission shops in the area and generally they are on the high end of automotive repair-there are a lot of derelicts and a lot of Inoperable cars outside that cannot be easily moved. Generally speaking they are a mess and he did not know that this was the right place for it. Commissioner Boydstun stated this was going to be at the entrance to Anaheim when the I.5 off-ramps are done. This is the way all of the traffic is going to come and they should be west of Manchester for this type of business in the Industrial area or someplace else in the area. This Is neM door to a restaurant which is closed right now, but they have the right to open another restaurant. She felt it was not the right mix. This is more of a business location and there was no way she could go for th(s. Commissioner Caldwell stated this was a bad spot for this use and that there are other places in the City where automotive repairs would make more sense. This l^ is not the location. Commissioner Messe stated they would certainly welcome the business In other areas of Anaheim. Commissioner Mayer stated she agrees with the other Commissioners, k is not a good location for this type of use. La Palma Avenue, Anaheim, CA 92801. She spoke with Mr. Joe McCray (Mr. Yalda from Traffic was not available on Friday) regarding the turn-around of the garbage truck, the enclosure of the garbage area, and the radius of the driveway. She stated, Instead of having the trash at the back because there is not a circumference adequate for the garbage truck, the designer put it so there are 2 parking spaces and then an arch radius that the truck will Just pull in from the street and then come back out. She had some drawings. She gave a brief history of the center. They still hold the dream of trying to provide a recovery home. She has outlined 2 levels. One Is a sober living environment. She explained the details. They are petitioning for the recovery home. They are going to start the sober living environment and work toward the recovery home. This will all be licensed by Sacramento. She explained that the people who would be residents would be chemically dependent, not organically defective people and they are not addicted by drugs. ^ Many of these people will be going to their regular jobs. They will be coming out of the program at the hospital and are not yet ready to go home and be in the environment that may have caused the alcoholism to begin with. THE PUBLIC HEARING WAS CLOSED. Jonathan Borrego, Senior Planner, asked about the type of freedom that the residents would have? He elaborated. Ms. Mommenny explained there is an 11:OOp.m. curfew weekdays and a 1:OOa.m curfew weekends with the house parent's permission wfth the exception of people who have swing shift employment. She explained further that each contract with each resident is worked out Ina 3 team member way wfth the partial program of the hospital; the referring Dr. and the director of the recovery home. She stated they will be able to drive their cars depending on the number of days of their sobriety. Most of them will have been in an inpatient partial program for 2 months. There are many factors to be considered. She elaborated. Commissioner Messe asked how many sober living patients they would have? Ms. Mommenny stated hopefully they would have 19 residents. Mr. Borrego asked about their policy on accepting visftors to the facllfty? Ms. Mommenny explained there will be one hour of visitation per day week days and 3 hours on each weekend day. They may need to have a contract drawn up with each of the participants. Due to work schedules, ft would have to 6e Individualized. She further explained that the physical setting is that the women are at one end and the men are at the other end and the common room is in the middle. They have stringent requirements regarding this. Commissioner Messe asked ft they discussed this with the neighbor to the wes'. with the nursery school and Ms. Mommenny indicated she had noi. Commissioner Messe asked if there were any objections and Ms. Mommenny stated she did not think so. Chairman Henninger asked about the outdoor living environment. Ms. Mommenny explained they have a large garden area in the back; they will have their own parking; people will not be hanging around in terms of being free all of the time. They will either be going to a partial program In a hospital or they will be very active all day in the recovery progrem of this center. No one will be Just living there and hanging out. Commissioner Caldwell asked if the people who run the nursery school have been notified by law? Page 13 `./ Mr. Borrego explained that the property owner would have been notHied. Whether or not the property owner Informed them, staff does not know. Commissioner Caldwell was concerned that this could be a potential problem. The parents also might be concerned. Ms. Mommenny explained they are in a medically oriented area.
