' Chairman Messe explained this is a case where the applicant has withdrawn his application, however, there is a matter of a reclassification which can be taken care of today. OPPOSITION: None ACTION: Approved Negative Declazation Granted Reclassification No. 96-97-04, unconditionally - Accepted the request from the applicant to withdraw Conditional Use Permit No. 3899. CONDTTIONAL USE PERMIT RESOLUTION NO. PC97-6 SR6406JK. WP 0 0 0 0 0 Jcel Hipps, 716 N. Euclid Avenue, S[e. 212, representing the church, stated he would like to discuss two of the conditions listed on Page 9 of the staff report. He stated Condition No. 5 limits the use to one year and Condition No. 7 limits the church capacity to thirty five people. He stated they have been in operntion at this location For one year and the church that was there before them with a very similar operation was there since 1989. There has never been, to his knowledge, a problem with noise or parking. Chairman Messe asked if the church that was there before them had a conditional use permit. Mr. Hipps responded he did not believe i[ did. Chairman Messe asked the applicant if he had a definite number of years he would like the use approved for. Mr. Hipps responded if he could ask for anything he would ask for as indefinite time period, but two or three years would be good. He stated he understands the concerns of the City not to make it indefinite. _. He stated Condition is No. 7 reads that attendance shall not exceed thirty five people. He stated the parking study was based on thirty five people attending. The parking available at evenings and weekends when they have then activities is one hundred thirty five parking spaces. The parking study found that seventy three of the one hundred thirty five spaces were occupied when they have thirty five people there. That leaves over fifty spaces available. They are hoping to be able to raise their attendance from thirty five to forty five at any given time. It seems like there is sufficient parking available for that based on the parking study. He staled the Building Division is concerned with the ventilation iFthey were to have over fifty people, but they would only like to increase their membership to a maximum of forty five members so that should not cause a problem. He stated the other conditions are fine. That is how they operate. OPPOSITION: None 01-22-97 Page 3 PLANNING COMMISSION -SUMMARY ACTION AGENDA STAFF'S COMMENTS: Cheryl Flores, Senior Planner, stated since this church is cursentty in opemtion, the timing on Condition No.,9 should be changed to 30 days Gom the date of this resolution and Condition No. I should be amended to read "That this church facility shall not include child day care or pre-school activity." ` PUBLIC HEARING WAS CLOSED. Chairman Messe asked if Traffic Engineering had any problems with the suggested modifications to Condition No. 7 relative to the parking study. A1Ged Yalda, Principal Transportation Planner, stnted they generally base the parking study on information that is given by the applicant. The only concern he has is that if the other uses in the commercial otFce building were to change their hours of operation and have more demand for parking. Otherwise, generally ] 0 people will not make a big difference for one hundred spaces available for the whole center. Chairman Messe asked if the current occupancy of the office building remained the same, they could take another ten people without any difficulty. Alfred Yalda responded yes. Cormrrissioner Henninger asked what Commission suggested they would do regarding the time limit. Chairman Messe stated he does not see any reason why they could not approve it for two years. ACTION: Approved Negative Declaration Approved Waiver of Code Requirement Czranted Conditional Use Permit No. 3900 for 2 years with the following changes to conditions: Modified Condition Nos. 1, 5, 7, and 9 to read as follows: I. That this church facility shall not include child day care orpre-school activity. 5. That subject Conditional Use Permit shall expire two (2) years from the date of this resolution, on January 22, 1999, and that prior to approval of any requested time extension(s), consideration shall be given to the stated characteristics of operation that are unique to this particular church use. 7. That the church attendance shall not exceed forty five (45) members.: - 9. That within 30 days from the date of this resolution, Condition No. 2, above-mentioned, shall be complied with.
