PC2009-050 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION APPROVING A CEQA NEGATIVE DECLARATION AND APPROVING RECLASSIFICATION NO. 2008-00219 (2125 SOUTH MANCHESTER AVENUE) WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for Reclassificafio~ on certain real property siYuaYed in Che City of Anaheim, Counry of Orange, State of California, shown on Exhibit "A", attached hereto and incorporated herein by this reference; and WHEREAS, tt~is property is in tl~e Indnstrial {I) zone with a General Plan land use designation of Medium Density Residential; and WHEREAS, Che property owner has requested approval of a Reclassification to reclassify the property from the Indostrial (I) zone to the MulYiple-Family ResidenYial (RM-4) zone, consistent with the General Pla~ land use designation of Medium Density Residential; and WHEREAS, tbe Planning Commission did hold a public hearing at Yhe Civic Center in the City of Anaheim on Apr9] 27, 2009 at 2:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60 "Procedures", to hear and consider evidence for and against said proposed reclassification and to investigate and make findings and recommendations in co~nection therewiYh; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and repofts offered at said hearing, does find and deternune the following facts: l. That rec3assification of subject property from the Industrial (I) zone to Che Multiple-Family Residential (RM-4) zone would be consisCenC with the proparty's existing Medium Density Reside~tial land use designation on the General Plan. " 2. That tUe proposed reclassification of s~bject property is necessary andlor desirable for the orderly and proper development of the community and is consistent with Ghe properties west and south of the property which are designated for mediurn density residential land uses and zoned RM-4. 3. That the proposed reclassification of subject property does properly relaYe to the zoues and their permitted uses loeally established i~ close proximity to subject property and to the zones and their permitted uses ge~aerally established throaghout the cflmmunity. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission has reviewed the proposal and does hereby fi~d that the Negative Declaration is adequate to serve as the required environmenYal docume~tation in con~ection with this requesC. - 1 - PG2009-050 NOW, THEREFORE, BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby unconditionally approve the subject Reclassification to authorize an amendment to the Zoning Map of the Anaheim Municipal Code to exclude the above-described property from the Industrial (I) zone and to incorporate said described property into the Multiple-Family Residential (RM-4) zone. BE IT FURTHER RESOLVED, that this resolution shall not constitute a rezoning of, or a commitment by the City to rezone, the subject property; any such rezoning shall require an ordinance of the City Council, which shall be a legislative act, which may be approved or denied by the City Council at its sole discretion. THE FOREGOING RE50LUTION was adopted at the Planning Commission meeting of April 27, 2009. Said resolution is subject to the appeal provisions set forth in Chapter 1$.60 "Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced by a City Council Resolution in the event of an appeal. , SENIOR S'ECRETARY, ANAHEIM CITY PLANNING COMMISSION STATE OF CALIFORNIA ) COUNTY OF ORANGE ) ss.
