PC2009-078 A RESOLUTION OF THE ANAIIEIM CITY PLANNING COMMISSION DETERMINING THAT A CLASS ll CATEGORICAL EXEMPTION IS T'HE APPROPRIATE EN VIRONMENTAL DOCUIvIENTATION AND APPROVING VARIANCE NO. 2009-04788 (3460 EAST LA PALMA AVENUE) WHEREAS, the Anaheim City Planning Commission did receive a verified Petition for a Variance for a deviation in the number, size, location, and height of freestanding monument signs and wall signs for a Kaiser Hospital campus, for certain real property situated in the City of Anaheim, County of Orange, State of Califomia, as more particulazly described in Exhibit "A" attached hereto and incorporated herein by this reference; and WHEREAS, the 27-acre property is cunently developed with a 4-story medical office building and is located in the SP 94-1, D.A. 4 zone (Northeast Area Specific Plan; Transit Core Area) and the General Plan designates this property for Institutional land uses; and WFIEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 14, 2009, at 2:30 p.m. notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18:60 "Procedures", to hear and consider evidence for and against said proposed variance and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. The applicant requests a variance from the following development standards to install new wall signs and freestanding monument sigris for a Kaiser Hospital campus: (a) SECTION NO. 18.120.090.140.1412 Maximum number of freewav-oriented wall si~ns (one permitted; five proposed). (b) SECTION NO. 18.120.090.140.1412 (c) SECTION NO. 18,120.090.160.1601 (d) SECTION NO. 18.120.090160.1602 Maximum size of freewav-oriented wall siQns (250 square feet permitted; 304 and 578 square feet proposed). Maximum number of arterial highway monument siQns (one permitted; two proposed). There are special circumstances applicable to the property, including size, shape, topography, location or surroundings, due to the large size and depth of the property, long distance of the buildings from the street, frontage on three streets, and khe unique regional nature of the hospital compared to other businesses in the vicinity. 3. Strict application strict applicarion of the Zoning Code deprives the property of privileges enjoyed by other property under identical zpning classification in the vicinity because similar sign variances have been granted for other commercial and industrial properties in the City. NOW THEREFORE BE IT RESOLVED that the Anaheim City Planning Commission has reviewed the proposal and does hereby find that a Class ll Categorical Exemption in connection with Variance No. 2009-04788 is adequate to serve as the required environmental documentation in connection wath this request. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission, for the reasons hereinabove stated, does hereby approve Variance No. 2009-04788 subject to the conditions of approval described in Exhibit "B" attached hereto and incorporated by this reference which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the health, safety and general welfare of the Citizens of the City of Anaheim. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption oFthis Resolution is expressly predicated upon appiicanYs compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State, and Federai regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. -2- PC2009-078 BE IT PURTHER RESOLVED that the applicant is responsible for paying all charges related to the processing of this discretionary case application within 15 days of the issuance of the final invoice. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of September 14, 2009. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 "Procedures" of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced by a City Council Resolution in the eXent of an appeal.
