F-Sfl-59-~R be Approved WHEREAS, The City Planning Commission of the City of Anaheim has received a Verified Petition from the property owner(s) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: The East '~ of the Northeast ~ of the Southeast ~ of Section 12, Township 4 South, Range 11 West, S.B.B. & M.; excepting therefrom that portion lying North of a line ~arallel ~ith and distant 666.00 feet South of the North line of said Hast '~"of the Northeast ~ of th~ Southeast ~ of $oction 12. EXCEPTING therefrom a strip of land described as follo~s~ Commencing at a point :n th~ South Xi~e of the East ~ of the Northeast ~ of the Southeast ~ of said S~ction 12, distant 210 feet West from the Hast line of said Section 12; running thence North parallel ~i~h the East line of said Sectio~ 12, 22 feet; thence West at right a~gles 60 feet; thence South parallel ~ith the H~st line of sai~ Sectio~ 12, 22 feet; thence Hast 60 feet to the point z~ of beginning, and further described as 8671 Magnolia, be reclassified from R-A, RESIDENTIAL AGRICULTURAL, to R-3, MULTIPLH-FAMILY RESIDENTIAL. J. R. McINTYRE and FLORENCE C. MclNTYRE, 8671 Magnolia, Anaheim, California, as Applicants. The applicants Mr. & Mrs. J. R. McINTYRE, 8671 Magnolia Avenue, Anaheim, California, as Owners, Ted E. Hudson, 523 East Vermont Avenue, Anaheim, California, as Authorized Agent, request that the subject property be reclassified from R-A, RESIDENTIAL K~XRXg~XX~RA"K AGRICULTURAL, to R-3, MULTIPLH-FAMILYRESIDENTIAL. WHEREAS, The City Planning Commission did hold a Public Hearing at the City Hall in the City of Anaheim upon said VERIFIED PETITION of RECLASSIFICATION NO. F-58-59-53 on the 2nd day of February , 1~59 , NOTICE of which said Public Hearing was duly givon as required by law and the provisions of the ANAHEIM MUNICIPAL CODE, Section ~200; and WHEREAS, Said Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said Hearings, does find and determine the following faces: 1. The property is presently classified as R-A, RESIDENTIAL AGRICULTURAL, a transitional zone. 2. The layout as presented represents a fine R-3, self-contained development, hut does present a problem in that three presently developed streets.~ould be dead-ended. 3. The ewners of the subject property maintain that when Tract No. 2303 was developed, they gave no indication that these streets would ever be extended. 4. The subdivider of Tract No. 2303 and property owners in Russell Ave. and Bruce Ave. protested the granting of this reclassification, however, it was believed hy the Commission that the owners of the subject property should not he penalized for streets that would largely hen&fit only the subdivider. 5. The development proposed weuld remain in the family of the present owners as a unit investment, with no sale of any dwellings to individuals. NOW, THEREFORE. BE IT RESOLVED THAT THE ANAHEIM CITY PLANNING COMMISSION HEREBY RECOMMENDS TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT RECLASSIFICATION NO. F- 58-59-53 be approved for Reclassification from R-A, RHSIDHNTIAL AGRICULTURAL, to R-3, MULTIPLE FAMILY RESIDENTIAL subject to~ -1- 1. The placing of Sdandard R-3 Deed Restrictions on one property limiting all dwellings to one story in height as shown on the layout presented. 2. The payment of $2.00 per front foot for street lighting purposes. 3. The payment of $25.00 per family unit for the acquisition of Park and Recreation sites. 4. The dedication of 53 feet from the centerline of Magnolia Street to the City of Anaheim. 5. The preparation of street improvement plans and the installation ®f all improvements ®n Magnolia Avenue in accordance with Standard plans en file in the office of the City Engineer. 6.
