PC 1958-1959-249 LUTION NO. 2,t9 - SERIES A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE 0ITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT RECLASSIFICATION NO, P-58-59-99 BB AP~OVHD. WHEREAS, The City Planning Commission of the City of Anaheim has received a Verified Petition fro=, the property owner(s) of certain real property situated in the City of Anaheim, County of Orange, State of California, described as follows: ~le South 7.5 acres of the North 15 acres of the east half of the sOutheast quarter of tile southeast quarter of Section 12, Township 4 South, Range J. 1 West, i~l tile Rancho Los CoyoTes, City of Anaheim, County of Orange, State of California and further described as being on the west side of Magnolia Avenue, approximately 330 feet nor/h of Lincoln Avenue. The Applicant, THE CHN'~IAL BAPTIST CI-~RCH OP ORANGH COUNTY, as Owner, McDaniel Hngineering Company, 222 Hast Center Street, Anaheim, California, as Authorized Agent request that portion of the subject property north of the Flood Control Channel be reclassified from R-A, R~SID~NTIAL AGRICUL'PJRAL to R-3, MULTIPLR FAMILY P~SIDENTIAL and that portion south of the Flood Control Channel be reclassified R-A, RBSID~NTIAL AGRICULTURAL to C-l, NEIGHBORHOOD CONIN~RCIAL. WHEREAS, The dity Planning Commission did hold a Public Hearing at the City Hall in the City of Anaheim upon said VERIFIED PETITION of RECLASSIFICATION NO. F- 58-59-99on the 8th day of June , 19 59, NOTICE of which said Public Hearing was duly given as required bY law and the provisions of the ANAHEIM MUNICIPAL CODE, Section 9200; and WHEREAS, Said Commission, after due inspection, investigation and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said Hearings, does find and determine the following facts: 1. ~lere is an existing chicken ranch on the east, on the south there is proposed C-l, on the north is tile church location and on the west there is a single family residential tract. 2. From a traffic angle, fire protection, trash collection etc., Yale Avenue should be extended to Magnolia Avenue. 3. Protests were received from residents on Yale Avenue, those residing on tile south side of said street all back up to C-l, Neighborhood Commercial. 4. There would be only one single fmuily dwelling that would be adjacent to dwellings permitted. 5. The subject property does have a hardship on account of being bisected by the Plood Control Channel. NOW, THEREFORE, BE IT RESOLVED THAT THE ANAHEIM CITY PLANNING COMMISSION HEREBY RECOMMENDS TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT RECLASSIFICATION NO. F- 58-59-99 be approved for R-3, Multiple Family Residential north of tile Plood Control Channel and for C-l, south of the Flood Control Channel and be subject to: -1- 1. /q]e filing of standard ©-1 and ]{-~ Dccd Restrictions of the Clam"of Anaheil~ - One condil:iol, in the R-3 Deed Restr.ictions to be that any Multiple dwelling erected on the subject property be limited to one story, 2. Tile dedica'~ion of 53 feet to tile City of Anaheim from the cen-~er line of Nlagnolia Avenue. 3. Prepare street improvement plans 8,nd instal], all .%mprovements in accordance with standard approved plane in tile .Office of tile City ~ngineer. 4. SubOec:: go approval of the ~lood Control District. 5. Payment of $2.00 per fron~ foot ou Magnolia Avenue for street lighting purposes. 6. E.~tend Yale Avenue to Magnolia, dedicate same and fully improve. 7. 'l_'hal; a subdivision map be filed. 8. ~lat a 180 day time limit be se~ for the accomplishment of the above conditions.
